Lester Munson: Brady has no shot in court

This guy seriously says in here that the Peterson case is currently on appeal by the NFL, and the NFL will "likely prevail", because "federal judges should stay out of arbitration rulings." Uhh... I don't think that's a law, buddy.

Why are we talking about what a disbarred lawyer for the last 20+ years has to say about the law?
I just find it eternally hilarious that "The Worldwide Leader" would employ Munson as their top legal analyst.

I did a quick search on Munson's opinion on this situation because I thought he was part of the "Brady doesn't want this to go to court" crowd. He has multiple articles in May claiming Brady has no chance in court. I imagine he just changed the date, added the information about the sentence being upheld and the phone being destroyed and turned in the same basic article.

It's certainly more ethical than stealing money from a client, which is why he was disbarred.

(That's from April 17, 1991, btw)

Lester Munson a few months ago gushed over the Wells Report too talking how solid of document it was. How did that work out for him?

Munson actually described Goodell's announcement yesterday as "masterly."

McCann thinks the odds are 60-40 in Brady's favor. https://twitter.com/McCannSportsLaw/status/626354786485600256

I trust McCann more than Munson. While everyone is saying the NFL will win jurisdiction because "first to file" rule, McCann was pointing out there are several exceptions to that rule including that if you file first because you know the other side is going to file and you want to get your venue before they do. Also, McCann is the only one who is saying the "destruction" of the cell phone is irrelevant to any court case because Brady never would have any obligation to turn over the cell phone while others said it is going to hurt him in court.

Yeah, it seems like there should be an exception, considering the NFLPA couldn't file until the NFL made their decision, and the NFL both made the PA aware of their decision and also "filed first" within an hour. There was no time for the PA to even react, much less get a suit filed. Seems categorically unjust.

Further, I don't understand what the NFL is even filing for. They hadn't been litigated against at all yet... I don't see how they can simply file for "we did something, can you guys tell the world we did it right?"

Mester Lunson, as usual, has it backwards.

There's some technicality to the effect that an arbitration award isn't binding until a court upholds the monetary damages.

The fact that there AREN'T monetary damages in the award wasn't addressed in the article I got that from.

A guy that was disbarred and is only known for getting everything wrong.

Let's not forget he is the guy who claimed Barry Bonds his lawyers got spanked in court when he was acquitted of 4 of 5 counts and the only count he was convicted of was the most minor count he was accused of.

Munson is a lightweight, but perfect for ESPN because he makes strong over the top comments.

I think Munson simply says whatever ESPN wants him to say. There's no consequences for doing so, considering he's already been disbarred.

And the 5th one was overturned, and the feds recently declined to re-prosecute it.
