I am very disappointed by the NFL’s decision to uphold the 4 game suspension against me. I did nothing wrong, and no one in the Patriots organization did either.

Despite submitting to hours of testimony over the past 6 months, it is disappointing that the Commissioner upheld my suspension based upon a standard that it was “probable” that I was “generally aware” of misconduct. The fact is that neither I, nor any equipment person, did anything of which we have been accused. He dismissed my hours of testimony and it is disappointing that he found it unreliable.

I also disagree with yesterdays narrative surrounding my cellphone. I replaced my broken Samsung phone with a new iPhone 6 AFTER my attorneys made it clear to the NFL that my actual phone device would not be subjected to investigation under ANY circumstances. As a member of a union, I was under no obligation to set a new precedent going forward, nor was I made aware at any time during Mr. Wells investigation, that failing to subject my cell phone to investigation would result in ANY discipline.

Most importantly, I have never written, texted, emailed to anybody at anytime, anything related to football air pressure before this issue was raised at the AFC Championship game in January. To suggest that I destroyed a phone to avoid giving the NFL information it requested is completely wrong.

To try and reconcile the record and fully cooperate with the investigation after I was disciplined in May, we turned over detailed pages of cell phone records and all of the emails that Mr. Wells requested. We even contacted the phone company to see if there was any possible way we could retrieve any/all of the actual text messages from my old phone. In short, we exhausted every possibility to give the NFL everything we could and offered to go thru the identity for every text and phone call during the relevant time. Regardless, the NFL knows that Mr. Wells already had ALL relevant communications with Patriots personnel that either Mr. Wells saw or that I was questioned about in my appeal hearing. There is no “smoking gun” and this controversy is manufactured to distract from the fact they have zero evidence of wrongdoing.

I authorized the NFLPA to make a settlement offer to the NFL so that we could avoid going to court and put this inconsequential issue behind us as we move forward into this season. The discipline was upheld without any counter offer. I respect the Commissioners authority, but he also has to respect the CBA and my rights as a private citizen. I will not allow my unfair discipline to become a precedent for other NFL players without a fight.

Lastly, I am overwhelmed and humbled by the support of family, friends and our fans who have supported me since the false accusations were made after the AFC Championship game. I look forward to the opportunity to resume playing with my teammates and winning more games for the New England Patriots

It still makes no sense that Brady would "destroy" a cell phone to avoid giving his cell phone over to Wells when Brady had no obligation to give over the cell phone in the first place and would never have to give it over even if he didn't destroy it. Brady's explanation is actually more plausible than the NFL's, but unfortunately the rest of the country will believe the NFL.

Holy f***! Tom speaks! The NFL is going to be screwed. "Brady destroyed his phone!!!" Or, Brady replaced his phone after telling you he wasn't giving it to you. Big f***ing whoop.

Fair enough - and the more Brady & co speak, the more the media will switch back in his favour I reckon. The NFL's desire to win in the court of public opinion may well come back to smack them in the face.

Which would be nice.

My guess is that Wells asked about the phone prior to his meeting with Tom in March, and Tom's legal team told him the phone was completely off the table. Around that same time, Brady's phone broke and he had to replace it, obviously. No one found any issue with this since they had already said "no dice" on giving his phone over. The NFL spins this to "on or about March 6th" Brady "destroyed" his phone... The true evil perpetrated by the league is about to be revealed.
 
I'm sure he didn't write that himself. But that doesn't matter. The two newest elements to his statement, IMO, are:
  • He's now on record as being confident that McNally and Jastremski didn't cheat. (Of course, he can't be TOTALLY sure, but that's still a clear statement.)
  • He's also on record as saying that he doesn't happen to be guilty of something else similar to what he's wrongly accused of. Or to put it more generally, he denies that he's covering up any kind of football-related wrongdoing.
Also, his statement is consistent with everything we've heard about settlement negotiations, except perhaps for a couple of NFL leaks that seemed fishy the moment they hit the media. What I'm referring to in particular is that:
  • We've heard that he offered to settle for a fine only, with some hint of a one-game suspension being the bottom line ...
  • ... but only if ALL he admitted to was non-cooperation.
  • The NFL was willing to settle for a reduced suspension, ...
  • ... but only if it made their charges look basically correct.
Those were the leaks that, when they came out, seemed like fairly legitimate acts of public negotiation. The "sealed records" bit, by way of contrast, seemed from the get-go like dishonest NFL spin.

Unfortunately, the damage is done. The media and public latched on "Brady destroyed his phone" and never will move from that. Just like to this day, there are media and fans who believe the Pats were caught filming the Rams' walkthrough before the Super Bowl.

I think Brady is going to file a defamation case against the NFL now. The funny thing is that the one reason all the "experts" said he would never do it is irrelevant now. He cannot turn over his telephone now.
