I don't think Deflategate has reached its peak yet

The reasons it took so long for the decision on Brady's appeal are 1) the NFL needed time to prepare its legal strategy to defeat the NFLPA in court, and 2) the owners wanted to put Belichick at the greatest disadvantage heading into camp.

Neither will work.

DeflateGate is about the league having unlimited power over the union and the players. 24 players have been suspended since last seasom ended, and the league has released a strange list of fines for everything imaginable to recover their money and exert control over the workers.

I think this law suit has the potential to be as important to professional sports as the Curt Flood challenge to the Reserve Clause.

The NFLPA knuckled under during the last CBA negotiation and is weak. Brady and his legal team bring a whole new dimension to the fight. It is a bit fairer, but I have no doubt the NFLPA will make mistakes. They are not as tough or as shrewd at the NBAPA or MLBPA.

I believe the entire DeflateGate process was illegal and the NFLPA should win. But who knows? That's why the venue and the judge are so critical. The NFL's pre-emptive strike to get the appeal vacated in NY before the law suit was even filed was a fascinating move. Who draws up papers to fight a law suit before it is even filed? The NFL has its teeth bared for this fight.

As far as messing with Belichick is concerned, this is a distraction, but not as big as the Hernandez arrest for the murder of Odin Lloyd prior to the 2013 season. The Pats did fine, made it to the AFCCG and lost for reasons un-associated with the preseason distractions.
 
We can not forget as this process goes forward, this isn't about whether or not Tom Brady is innocent or guilty. That won't be brought up in court. It's going to be 100% about the process and fairness.

So if anyone is hoping to hear about Tom's innocence, you'll be very disappointed.

What we as fans want or hope for is totally irrelevant and it always has been....unless you just want/hope he gets to play all 16 games+.

so then lets assume that the appeal fails and Brady's suspension is upheld.

wouldnt it be great if he comes back and just drops the hammer and goes all out to SB 50 and wins the whole ****ing thing.

i know its a dream but it would certainly piss off the entire NFL and make Goodell look like a complete jackass again.
 
Strange Day, Brady volunteered information he didn't have to, that the NFL would never discover without discovered, Goodell made the phone the main justification for the sispension. He also doubled down on Exponent's science


Brady got killed in the court of public opinion. If he wins the NFLPA lawsuit on the process, and it looks like the NFL is scared to get in front of Doty again, the only way for Brady to get close to getting his reputation back is to go all in with a defamation lawsuit, go after the NFL execs who framed him and Wells/Exponent.

Yep.

At this point, fans should support the best legal strategy that gives the Pats the best chance to go 19-0.

That best chance is TB12 behind center.

If it means filing injunctions and arguing unfair labor practices and CBA violations, so be it.

While critical in discrediting the actual motivation of the NFL, arguing about the Ideal Gas Law in court is not the best strategy.

It'll take some time but posterity will define TB12 as the GoAT who steadfastly proclaimed his innocence and refused to cave into the NFL and public pressure.

The court's findings will determine if he was stupidly stubborn or a man with strong conviction who refused to admit guilt because it was the easy path but chose to defend his innocence, honor and legacy.

Of course that would be the stuff of fantasy & legend and something we can hold onto as we move through the season. The tough part is unforseen injuries....
