Brady's legal team rope-a-dopes NFL into big mistake

I dont think the nfl lawyers rendered this without anticipating the court appeal. Iam sure they will have enough to protect themselves. Considering what has gone on in the bizarre story Iam not 100 % confident liek the others about the court stuff.
Court is never ever 100%. The unfair labor practice element is 100% spot on but judges are people who can do wacky things themselves. Odds are greatly in favor of good result but nothing is ever 100% The NFL is looking for NY judge for a reason.
 
Think you should bone up on the history of the nfl in court cases against suspended players. There is a reason why they ran to a ny federal court to attempt venue shopping. This goes to Minnesota and Doty they are done.
They were in a weak position before, they are in a worse position legally now but their court is the owners and they make points by trashing anything Patriots. Pay me $44M a year and I will go after Tom too.

I was in a room full of Patriot fans during the Superbowl against the Rams and when the Rams scored the tying touchdown, everyone let out their inner doubt. "I knew it was too good to be true". I told them "it ain't over yet", Then the Pats won.

I was in NJ in a room full of Yankee fans in 2004 and the Sox were down 0-3. I told them it "ain't over yet",...and they won. Yes Sah.

Now I'm telling you............It ain't over yet.

They are screwed when the two most under the radar thing gets dropped in court.

"Why was Stephen Gostowski not punished for refusing to hand over his cell phone" and "How did you come to your ruling on Brett Favre when he refused to hand over his cell phone"
 
All on Brady's shoulders. This is bigger then any super bowl. I've lost faith in a favorable outcome, maybe Tom can show me I'm wrong if it's only for the last time he can pull off a miracle.
 
Most likely Tom panicked and decided to destroy the cell phone because he was worried about potentially being forced to hand it over, it being very likely that Wells heavily insinuated (lying) that he had that power.

No grand strategy. No 4 dimensional chess.

I agree that it's entirely possible that Brady trashed his phone in an effort to hide deflategate information from the NFL. Having noted that, however, I have a request:


Please, give us the percentages of his 'likely' reasons...

I don't know what was going through his mind, people do dumb things when they are under pressure they aren't used to. On the field he's ice cold, off the field who knows how he was feeling staring a severe punishment in the face.

The point is the move doesn't make any type of sense unless it wasn't done for a sensible reason.

The sensible reason is this: It's his phone and he can do what he wants with it. The NFL can request that Brady commit suppuku while goodell sits in his throne touching himself. Doesn't mean their request is legal.

Now now. Tom Brady panicking is far more likely of a scenario than the one where he's doing something like "following the advice of counsel" or "getting a new phone". o_O
 
Roger Goodell was never aware of the Ray Rice video showing Rice smashing his fiance in the face and knocking her out. If he had, he would have reduced the penalty to no games. The video of Tom Brady thrashing the hapless Colts into a blood puddle in the playoffs is PROOF he did it deliberately! No reductions here!!! 15 yards..trashing your cell phone.We don't need cameras at the goal line..we need ball pressure security!!! Fine Belichick another million dollars for cell phone unknowledge!

All right, been thinking about this and bouncing it off labor people. Why would Bradly destroy a phone he is not even required to hand over. Here is a theory which makes sense.

The first reaction people will have is "Brady's getting his legal advice from Aaron Hernandez...destroying your phone on the day you are talking to Ted Wells is insane! But is Brady really Hernandez stupid? He does not even have to turn it over.

Brady and his team are smart people... so the real question is why would they snub noses in such a fashion?

To get a response. What response? To get the decision centered on non-cooperation on the phone issue. Destroying something you don't even have to turn over is done for a reason knowing it is a slap in the face.

Why? Because demanding a private individual's phone is an unfair labor practice.

The Vincent decision didn't hit non-cooperation hard enough.

The NFL probably didn't even know Brady destroyed the phone until the appeal hearing. Brady could have just said "I'm not giving it to you". Instead he testifies "I destroyed it the day I went to Wells, so you aren't getting it."

Goodell loses his mind. Bases punishment on unfair labor practice. Rope-a-doped into it.

Collective bargaining agreement: court can't touch rules based interpretations. It does have jurisdiction to address unfair labor practices and violations of collective bargaining agreement. The new document today is all about the phone.

Brady's team just suckered the NFL into moving their punishment basis and report to an area which is 99.9% favorable to Brady by destroying a phone that Brady would never have been forced to turn over.

Hard to believe they would rely on the NFL to make the mistake you suggested.

Suppose Tom's legal beagles indicated that some point after an appeal he may be required to turn over his phone. Tom's reaction may have been I don't want to give my friends confidential messages to anyone.
Legal beagles then told him to record all people he sent or received messages from and the date and
then destroy the phone. If the NFL wants a particular message then go to the person and request it.
All evidence in the phone is still available but Tom is not in the position of giving up confidential information rather the person(s) whose confidential message is of concern makes the decision to turn it over or not.

However, your idea may have just one of many landmines Tom's legal beagles laid down hoping the
NFL would step on at least one. In this case, destroying the cell phone may have accomplished
two things .... protection of friends and a Labor law trap.

The NFL finds it perfectly acceptable to tell the world about how Tom Brady uses his phone and the Globe finds that worthy of an article. Tell me now that the contents of those text would have stayed private. The fact that he text a lot is already a known fact around every household in America. That's pathetic. How anyone can pretend they don't think Brady should be evasive with his personal communications is amazing. People are actually criticizing a US citizen for not allowing his employer to violate his right to privacy.
