My point was that once again, we hear the real truth after the bomb has been dropped. That's been the case all along.
Yes, there have been ups and downs in the media battle, but there's no doubt in anyone's mind that the NFL has gotten the better of them in that regard, and it's not even close.

This is a marathon, not a sprint. No good PR firm will ever be able to spin the court overturning this atrocious decision... and ripping it to shreds as any good Judge would.

KEEP IN MIND - this is a LEGACY court case! Whoever presides will have their name attached to it, and have it read and dissected by law students and professors of the future. No one wants to look like Wells part 2 and I cant see ANY good argument in favor of the NFL, if this case is heard. Which is why the NFL is hoping it wont be heard...and their decision upheld. Hail mary pass... deep in the end zone....
 
He asked for the texts on the phone and destroying the phone potentially (and it seems like it happened ) destroys the texts, so no you don't destroy the phone. I would fight hard to keep from having to turn over the phone, but that is different from destroying it. I'd like to hear the explanation for this from the Brady camp because now there is no good explanation. All we are hearing now from anyone outside of NE is that Brady is a cheater and destroying the phone proves it. I think Brady did nothing wrong here, but destroying the phone makes it real hard to mount an argument in favor of Brady. Maybe there's a good explanation and if so let's hear it. Yeah, the I think phone is a red herring, but to anyone who has not invested any time in understanding what has been going on it is red meat.

The NFL has always had the edge in the battle for public opinion, in terms of getting in the first shots.

It's on the offensive
It can order the other side not to speak (see football numbers)
It can pressure the big media

The Brady camp has been winning the aftermath arguments. In the end, if this is actually heard in Federal Court, what's happened so far isn't likely to matter all that much. The court will uphold/strike down Goodell, and public opinion will eventually follow that decision.
I'd like to think so too but the problem is that this is not just a regular disciplinary action/lawsuit. The PR aspect is an enormous part of all of this. Part of the reason for Brady to fight it is to defend his reputation and integrity. Public perception is a part of that and if the NFL continues to win the PR war, and they are winning it, you become the public perception. A quiet win 6 months from now when everyone is paying attention to the next Caitlin Jenner does little to change the public perception.

I think it's reasonable to believe that he destroyed his phone. I can't imagine the NFL would be so stupid as to blatantly lie about such a fact given that a court case is around the corner.

Then again, I guess you never know with these idiots.

If this were not true, why wouldn't Brady and the NFLPA be shouting this loud and clear? What possible benefit is there in keeping silent?
 
100% This.

*I* saw the tapes on the FOX show. So did millions upon millions of other people. It showed the defensive signal, then a quick pan to the down and distance on the scoreboard. It repeated 3 or 4 different times.

People outside of New England must have seen this too. I'm pretty sure the entire country was getting the broadcast.

There surely has been to be a link somewhere on the internet that has that glazer broadcast of the tapes. Still can't believe how that stupid thing blew up out of control.

Well I think the thing is, there's "destroyed" as in "factory reset and given to phone carrier to recycle" and "destroyed" as in "backed over 12 times with a steamroller".

The league's choice of words has left the impression that it's the latter.

But shmessy's right, so far the league is the only one that's actually said it definitively. (Well, that and all their media outlets)

This is one of my favorite things. Other teams' fans are convinced he did this to protect the Patriots, but this is ridiculous. Given how totally banal the actual tapes would have been even at their most incriminating (oh no... it's a tape of a guy waving his arms randomly), one imagines it was just the decision of a stupid man raised from birth to be commissioner but hopelessly out of his depth.

To repeat:

The Patriots complied with every request of the NFL in the Spygate case. The results were that:

  1. A tape was leaked, and that tape is still out there and shown today, according to its possessor
  2. The Patriots are still called cheaters to this day, despite the obviously harmless nature of the filming
  3. People began claiming that the tapes were destroyed to protect the Patriots from being found doing even worse things

Some aspects of PR were lost a long, long time ago, and they're never going to turn into a win. That's irrelevant. People here need to pull up their big boy pants and move on. This case is now in front of the Federal Courts. If the Federal Courts hear the case, Goodell's likely to eviscerated, once again. If that happens, the PR war will be: Victory - Brady

I won't lie, I immediately was kind of mad at Brady for failing to recycle his phone. Man, those rare earth metals don't grow on trees!

Those were lost in 2004. 3 Super Bowls in 4 years tends to do that. Everything from there on out was icing on the cake. There's no hope for the Patriots and PR in the Brady and Belichick era, fans just have to realize that we root for the NFL Bad Guys and have for the last decade-plus. Nothing Brady does or can do will change that. The only legacy that matters is on the field.

But here’s the thing. If those are the arguments the NFLPA had previously planned to make on Brady’s behalf, why did he even testify at the appeal hearing? The points raised above could have been established via stipulation or other evidence. Having Brady admit that he destroyed the phone interjected an issue that will hamper Brady in the court of public opinion — and that could prompt a judge to conclude at a visceral level that justice requires upholding the suspension.

Although the destruction of the phone may not be relevant to any of the issues raised in the litigation challenging the suspension, skilled judges can find a way to get to whichever conclusion they believe is justified, even if the motivation to arrive at that destination comes from facts technically irrelevant to the specific issues presented in a given case.

In other words, if the presiding judge (whoever it ends up being) believes Brady’s hands are dirty, the judge will likely be able to find a way to rule accordingly, even if the written decision never mentions the destruction of the cell phone.

I was referring to them being lost in 2007, but the roots of the hits are certainly firmly in 2003 and 2004.

It's probably more accurate for me to say that the Patriots began being an automatic loss in some PR aspects when they won three titles in four years, and the "Patriots way" began wearing thin on the fanbases of every other team, and that such a loss was bound to be compounded once Tags was out and Herr Goodell was in.

JG: Well, I got a call from Sen. Specter and he asked me to meet...first off, there was some ridiculous report out there that said I had agreed to hand over the tapes to Congress. I do have the tapes, but am not doing that, nor would I, and if they want to see them, I show them at parties all the time, so they're more than welcome to come over to my house and see them. Well, the first part of the tape, the guy recording it , all he's focusing in on are the butts of the Jet City Dancers. He goes into the stands and then focuses on T and A. It is classsssic. It is like Spygate meets "Girls Gone Wild."


And that's what's on the tapes that everyone's getting upset about? Does that damage the credibility of those tapes at all?


JG: Oh, no, no, no,no — because the rest of it, is damaging. Because they go the coaches, to the down and distance, back up to the coaches, back to the down and distance — it couldn't be anymore clear. They focus in on three guys the entire time, it is soooo brazen it's incredible.


So, how long did you sit on that for before you went with it?

JG: Oh, I got the tape that week and showed it that week. The only thing I had to wait for was Fox NFL Sunday. My boss at Fox, I have to give him a lot of credit, they were nervous, they were concerned and I said to them "Guys, I'm not telling you where I got it from, I'm never telling you where I got it from, and if you want to know where I got it from? If that's the problem, than I won't run it." To their credit, they just said "Jay, the NFL is going to launch a major investigation into how you got it..." I said, "That's fine, they'll never find the people. Ever." And thank God because all of the Fox people stood by me. And after that, people thought I was going to lose my job over it because the NFL was calling me and asking me where I got it. To this day, even the producers at Fox have NO clue where I got it from. Nor would I tell them. And I said to them, "If you ever try to make me, I'll lie to ya." I'll die before I tell anybody where I got it from.

Will you go to jail for it though?

JG: Oh absolutely.

What Glazer obviously doesn't realize is that what was taped isn't actually illegal, it's where they were taped from - but that's not unusual, the NFL made sure no one actually knew that.

In the end, it's all just entertainment, and these sort of controversies are the soap opera that fills the week in between games. The league and its media buddies like ESPN shape the narratives that get played out. Today's NFL has more in common with reality TV than it cares to admit, but one supposes we all end up with some sort of fulfillment out of it since the drama makes very little real difference to any of us. The big bad cheating Patriots is a storyline that has been milked for the better part of a decade; why stop now, even when it risks the wrath of real-world labor law?
