I would also like to point out text messages sent back and forth show up on both parties phones. So if they had the ball boys phones they would have seen anything from Brady on there. The carrier can verify the usage of the device and see who Brady sent the messages to or received them from without the phone.

I'm not to worried about the situation. Jimmy G is going to have a great 4 game stretch, so good that teams will be throwing trade offers at us, we will trade him mid season to the Browns for Joe Haden and 2 first round picks. Brady will return and dominate the NFL. Roger will hand us the Lombardi in February and announce our top 10 draft pick in April. Thanks for playing Goody..

why not just ask goodell where his old phone is?

Or ask him to hand over his current phone to make sure he did not conspire against Brady or better yet that he's not a rapist. The NFLPA has no evidence of either, but they can make the accusation. I wonder if Goodell would hand over his phone despite having no legal obligation. I wonder how he would react if his refusal would be the deciding evidence to convict him.

Well, if he can play (Garoppolo), I dunno if I'd want to trade him, even for Joe Haden.

Also, if Cleveland traded two first round picks, one can't be next year (thanks to Bob Kraft), so I don't think they'd have their own first round pick until 2018 or 2019.

I like your thinking though, generally.

Most data can be recovered regardless of the damage done to a device, we do it all the time. The one thing that will fix it for good is fire, electromagnetic destruction or pulverizing it. On a mobile device most people don't save anything to a sim so if they reset the phone the data is mostly gone, some can be recovered by the mobile vendor depending on thier policies. Good luck getting iMessages back, and dont think you'll get apple or Google to share any data with the legal system, they have already won those cases even against the federal government.

We can have the Browns first we only forfeit our own picks we can not be docked trade acquisitions.

I'd trade JG cause Brady is going to be reborn and play for another 5 years.

Actually no. The initial punishment made it clear that the Patriots cannot trade for another pick in the first round. This was put in by Vincent (or Goodell, whichever), because the Patriots traded for a first round pick in 2008 after Spygate.

The Patriots will lose the highest 1st round pick they have in the 2016 draft. That means that they can trade for a 1st, but they will lose the highest. If the Patriots were to come in last place, they could trade for pick #2 and lose #1. If they win the Super Bowl, they would lose the #32 pick or the best pick they acquire above it.

Would Goodell really use the term destroyed if all Tom did was reset?..The average person is dumb, but no way anyone would buy that.
Where have you been? Of course he would, goodells been lying since day one.

I worked for VZW between 2003-2008 in retail stores and in B2B sales. My wife worked there until 2011 and I still have many friends who work there and at other carriers.

I can say unequivocally that just about everyone does a factor reset on their old phone when they purchase a new one.

In general the word "destroyed" is being misused here. Tom Brady reset his phone, to wipe his content off of it.

On a side note - I am sort of glad Goodell upheld the suspension, if he did something else it would have opened up the possibility that he will not be exposed for the worthless, lying, manipulative, piece of **** that he is. Goodell embodies everything that is wrong with this corporate America.

I would like to hear more details on the disposition of the phone - from Brady's side: (A) Was it "destroyed"(broken into pieces) or was it erased/set back to 'out of the box'? (B) What day and time exactly was it shattered or erase-reset?
On point A, when the NFL says "destroyed", it conjures up a person breaking it into many pieces. IMHO it is reasonable to interpret this act (if it the case) as being suspicious and the act of a man who believes he has done something wrong.
If, on the other hand, this was am erase-reset then it immediately and significantly reduces the level of it being a very suspicious act.
Look it is quite probable that Giselle sent pictures to Tom that would be completely inappropriate for anyone else whatsoever to even be in possession of the phone for a minute (just look to the big I-hack and the many dozens of actresses having their private nude pictures released to the public to know how that works). There are a few other reasons other than deflategate for Tom to be worried about the phone getting into others hands. But it is still reasonable to have suspicion of even an erase.

On point B, IMHO this is probably more important than the state of the phone itself. What day was the phone broken and/or when he asked someone to do it?
To me point B is big. If this was in fact just an erase (not a smashing of the phone) and if the phone was old enough for it to be swapped to a new model (something countless people do after 12 to 24 months), that makes the word "destroyed" a very sensational description to use, it is an overt act, and an admission by proxy, that the NFL wants Brady to be guilty, and fairness/actual guilt will not be part of the NFL's MOD (not that it was in doubt - but this would be a grossly blatant tactic).

I have agreed with Brady and his team remaining quiet up to now but on the phone 'destroyed' issue someone from his side needs to release a clear and succinct statement of what the NFL meant by "destroyed". To let this word go by without a clear response is, IMHO, game-set-match for consideration of guilt. Even a federal court win will be a procedural win without any innocence attached to it. That would be a shame...
