I want to know the rest of this story? Would you destroy your phone if Wells had let you know he'd ask for it? Would you destroy it with seeking the advice of counsel? Would you destroy your phone if NO incriminating evidence was on it, considering how bad the optics would look?

I wouldn't. I'd turn it over to my attorney, lock it in a safety deposit box, put it away somewhere. It just looks bad.

I felt the same way after the Wells Report first came out, but after a few days discovered how one sided it was. If this were true as Goodell implies (Brady destroyed the phone after knowing it would be requested), why would they have waited 35 days to issue a ruling? That doesn't make any sense either, unless this was the stick Goodell was going to use to get Brady to take two games in exchange for no lawsuit. I'm going to wait and see how this all plays out.
I would have smashed it against the wall in front of Ted Wells and wiped my ass with his request. Because F*** Ted Wells.

That's obviously not great advice, but I would say it's at least a common and understandable reaction when dealing with an a**hole and instead of indicating guilt merely indicates that Brady either didn't care, OR correctly identified that Wells is an a**hole.
 
If the NFLPA proceeds as they indicate below:
  • The NFL had no policy that applied to players;
  • The NFL provided no notice of any such policy or potential discipline to players;
  • The NFL resorted to a nebulous standard of “general awareness” to predicate a legally unjustified punishment;
  • The NFL had no procedures in place until two days ago to test air pressure in footballs; and
  • The NFL violated the plain meaning of the collective bargaining agreement.
will Brady's text messages even be relevant and something that can be subpoenaed?

Well, there are two lawsuits going on. Brady's and the NFL's. The NFL's which is about upholding the suspension could perhaps subpena the text messages. Could, mind you.

This is what I've been wondering, too. I'm kind of curious as to just how Brady "destroyed" his phone; and whether it's really as dramatic as it sounds. Like you brought up, I say this for two reasons....

1) from the very get-go back in January, the NFL would come out with seemingly damning evidence...only to have counter-evidence get released that made everything look far less damning than originally suspected. Specifically, the NFL originally claiming that 11 out of 12 footballs were 2 psi under. Then, the tape of the ball boy taking balls into the Bathroom...only for NE to reveal that they pointed out this evidence and it was only 90 seconds long. There were quite a few more minor back-and-forths too.

2) It makes absolutely no sense for Brady to destroy the phone. Especially at that time (early March, right?). He had his lawyer present by then. He'd know that the phone wouldn't be forced out of his hand. Even if the phone had a total smoking gun of a text message that fully incriminated Brady; he wouldn't need to physically destroy it. Not just that, but even if Brady really did destroy his phone; why would he openly admit this? Everyone already knew he wasn't giving up his phone. That was clear. No new news there. So why would Brady acknowledge this (or why would his attorney allow him to acknowledge this) when it's been clear that Brady won't be forced to give up his phone; even if it goes to court (as it will).
 
So… Brady gave the NFL list of the 10,000 texts he made, with names, dates, and times

The NFL decided it was “not practical” to pick out the 4-5 people on that list that they think might be relevant, contact them, and ask their permission to see those particular texts. The NFL got lazy.

They spent 5 million bucks on a sham report and dragged it out for 6 months. They couldn’t take... what...2 days to follow up on the very information that they had asked for?

And I want to be crystal clear, I told Mr. Brady and his agents I was willing to not take possession of the phone, I don’t want to see any private communications, I said, ‘You keep the phone, you give me documents that are responsive to this investigation and I will take your word for it’ and they still refused.”

Now, they are upset that they can't get his physical phone.

These people need to be held accountable.
 
Well so far Dan Lebatard has been the only voice of reasoning I've heard since this whole destroyed phone story broke. He's saying what if there's nothing on that phone to do with deflategate at all, what if he has something on there as some have suggested pictures, or said something negative about Kraft, Belichick or another nfl player etc (he was just throwing out random scenarios ) but he stated if I was Tom Brady I wouldn't want to give my phone to the nfl either with all the leaks and the nfls creditabilty issues, even if there is nothing in there at all about deflategate. To bad not many others can think like this.

Lets get real here because you provide a list doesn't mean that is all you texted to it means those are the ones you provided. No verification. Just too many irregularities, Tom. You are the GOAT and I love you but hire someone smarter than you to protect yourself.

But...aren't all communications on a cell phone private (unless subpenaed by a court of law)?

Wasn't May 8th before the 11 hour appeal hearing?
 

If I can not confidently wipe my phone, I destroy it. I am not famous. I do not have a job that deals with a lot of sensitive gov/client/corporate information. And yet I still find my privacy is important enough to do this. The most disappointing thing out of this whole proccess is the large group of morons that find it acceptable for an entertainment company to ask its employee to turn over communications made on his personal phone.

Right, Yee and team had not yet presented this list to the NFL; they did so at the appeal.

And what do you know, he was right: it was met with skepticism!

They already HAVE all texts between Brady and Jastremski/McNally.

The funny thing about texts is that they show up on both the sender's and receiver's phone.
 
They have no right to demand his phone.PERIOD! It was a private phone, not a company phone, not an NFL account phone.
The NFL received transcripts, whether it was too hard for them to verify or not. That is what they got!

You cannot assume guilt because you cannot obtain something.

If I was being railroaded by these treacherous little bastards, I would have destroyed it, and then Fedex'd it to them in little bitty pieces.
