Breaking: TB12 Authorizes Federal Court Case!

If the NFL were afraid of a court case, then they would have reduced the penalty for 4 games to $50K.

I forgot where I read it, but it makes sense for the NFL to take it to court. This way if the court overrules, Goodell can just say 'Hey, not my call'.

I know we haven't heard from Brady on this yet but I seriously doubt (1) he would have destroyed his cell phone without checking with his lawyers; (2) any lawyer would have advised him to destroy the cellphone without backing up the DATA somewhere; or (3) Brady would have destroyed the cellphone without backing up the DATA against his lawyer's advise.

If I'm wrong, then either Brady or his lawyers really messed up badly but I doubt that's the case.

We should probably all just reserve judgment until all the facts are in. If only for the sake of our collective mental health.

So am I the only one that is worried about Brady not getting a truly fair judge if this goes to NY?

They are a long way from Ny right now. This could change locations 2 or 3 more times before any sides are heard.

Haven't read all 8 pages. NFLN is pointing out that if he gets the injunction and the timing works out wrong, Brady might sit in Dec. or January rather than in September.

He sits he might as well say he lied

What does Brady do if he loses in court?

Wins another three titles, retires to family life with his millions, and tells the NFL to stick the HOF up their asses. :)

Patriots organization (after "The Hug" yet) crying about how disappointed they are. Feh.

NFL Network reports the sides were "moving close" to a settlement that would have reduced Tom Brady's suspension to one game, but that the league refused to "seal" the records.

Rapoport

Sorry if this was posted

That is surely an anonymous leak from the NFL's side.

And the credibility of that is ... ?

One place you may have read it is in this forum, where it's been said many times ...

he destroyed the phone before kessler was hired. so the only attorney he would have consulted is don yee. i honestly don't think yee has done brady any favors. it was HIS letter to the NFL right before the appeals hearing that stated brady destroyed his phone.

I'll be impressed if there is a hotly contested case and it still gets wrapped up in less than six months. Considering the NFL is apparently choosing to fight over jurisdiction, it could take months just to decide where the case will be heard, much less actually get a decision.

BTW, NFLPA lawyer George Atallah 3 hours ago:

Any report that suggests two sides were coming close on a settlement in the Brady matter is rubbish. Plain and simple, rubbish.

.

Unfortunately, the NFL has already filed their own case in NY.
Their claim is kinda confusing. They want the court to uphold the suspension? What's the conflict? Nobody has filed a claim yet against it.

I think there's a name for that, but I'm not sure what it is.
