You people remind me of the OJ is innocent crowd, he destroyed it because he was part of deflating footballs after they left the officials room. JFC get real. I think it mattered 0% as far as competitive advantage is concerned but he knew. Big deal.To equate it with steroid use as RG did is a complete joke.
So he was instrumental in deflating the footballs by no psi? What would be the use of that?

any legal experts care to comment on this?

this contradicts the opinions from another lawyer

Looks like she is already aware of the article.

@jjcoop36 Man, many things not exactly accurate in that, too hard to explain in 140 characters. It is overly simple, gets some facts wrong.

@JSKim__ Seen that. There's a lot wrong with that beyond 140 characters, but then again, judges, lawyers disagree.

Just shear stupidity that he destroyed that phone when he did.

speaking of stupidity...research the difference between "sheer" and "shear" before you go off on OTHER people's stupidity, Rhody.
He must have felt fleeced.

I'm so technologically dumb that I thought text and other such records went to the great big cloud in the sky where they were never lost so that the geeky guy on NCIS can retrieve them with five minutes left in the show to nail the bad guys and save the universe from destruction. But, what do I know?

Anyway, I'm still waiting to hear Brady's version of this. I'm not inclined to believe the NFL's version of anything.

Otherwise, I fully understand that he wasn't required to turn the cell phone over under the CBA, and I fully understand that whatever happened to Brady's cell phone fails to change the facts on the ground about the disciplinary process in general and the Wells investigation in particular AND I also fully understand that lots of folks destroy their phones when they get a new one (I don't because I'm afraid it will explode or release harmful radiation that will leave my home uninhabitable for decades if I try to destroy it, so I just throw it in a drawer).

But, assuming the unlikely circumstance that the NFL is right about the date of Brady's sending his cell phone to cell phone heaven, I do think that his timing in this regard could have been just the teensy-weensy--tiniest little bit better when it comes to the court of public opinion.

I feel pretty good. On vacation this week poolside.

People are all up in arms over this phone today and I'm not surprised by it. Nor am I alarmed.

This whole fiasco was created by the NFL for one thing and one thing only. To create the perception that the league office is not inept after all their recent failures.

In going through with this the way they did, they violated the cba agreement so fiercely that labor law with have no choice but to take this case.

Look, I understand the panic but it's not like we haven't seen this before. It's one stage after another. First with the outrageous accusations from a bitterly defeated rival. Then with the verdict being read by Vincent which was a first btw. The so called neutral arbitrator. A lot of you act like this is some sort of surprise?

What's different now is that Brady and his team actually get a true say in the process. No more information withheld, no more Espn defamation and slander at key points of the hearings.

I trust in Brady and his team and I expect that it will be on a more even playing field where labor law gets a chance to look at the entire process and events.

At first this was about Brady but after reading from the random labor lawyers out there, Don Yee and the NFLPA it is much bigger than Brady. It's now about bringing down a dictatorship that thinks it answers to no one because it was voted in by the Players Union. The NFL has gone above extreme measures and it is time they were called out on it once again. With all their recent failures I would hope it will be grounds for change from a fair outside source like a Federal court who will be able to identify wrongdoing and correct it if necessary .

The worst part of the whole cell phone thing is that is what people are going to use as "proof" of Brady's guilt, even though it has very little to do with the case. It will just embolden the football fans that are biased against the Pats and those that are too lazy to look into the details of the entire case.

Then why did he destroy it??

2nd time posting this:

10,000 texts with 1 % questionable = 100 texts that could be misinterpreted or correctly interpreted. That's only 1%, everyone has 1 % of texts that could be embarrassing and detrimental.

For example:

1) my teammate is stoned! (that would buy that player a random drug test).

2) my wife is a (censored)!

3) my coach is a dope!

4) I cheated on my wife!

5) I saw him cheating on his wife/gf!

You'd have to be a total selfish moron to give up your phone and expose others to a biased person's scrutiny. There are no dead people here.

Finally, without the phone the NFL has nothing more they can add against Brady ( he was already questioned under oath). The NFL is now in a corner. The only thing they can do is to keep this out of court.

Then why did he destroy it??

You can tell me someone murdered someone and present to me a list of damning circumstantial evidence but if the DNA doesn't match, then the guy is not guilty.

The NFL has created an excellent PR campaign to label a guy a cheater and wreck his amazing 15 year career over a worst case scenario of 0.3 psi and I just will not support that nor do I believe it.

Then why did he destroy it??

Because it his Privacy. Period! His family, friends, business deals. Seeing how Goodell* & NFL* conducted this investigation would you give up your cell phone?! According to Yee, whatever Wells wanted concerning his cell phone, texts etc, it was given to him. Now, because Goodell* knew he had to come up with something because tables turned on him with Mediots and Public Opinion he throws this nugget out there. Go to Federal Court, get an injunction, Brady will play this season until case is heard. In mean time, he will be a man on a mission (as always) but more so. Lookin forward to SB 5, One For Middle Finger!

I understand the bar is high for a deformation lawsuit but if Brady does file one I have some wonders:

1. I wonder if all parties involved will have their phones available or will they too end up destroyed.

2. I wonder if Kensil will explain why he destroyed the evidence at halftime by re-inflating those footballs.
- Was it because he had no idea weather could cause a football to lose pressure?

3. I wonder what Walt Anderson's recollection of the events that transpired in that locker room at halftime will be. Will he remember that Kensil was confused as to why the Colts footballs were below regulation as well and then in a panicked frenzy had all the footballs re-inflated?

4. I wonder why it took so long to correct the letter sent to the Patriots with falsified data.

5. I wonder what JJ and McNally will have to say.

and many many more........

I wonder if Roger's career can survive a defamation lawsuit whether or not Brady wins it or not.

Why destroy it when he was never compelled to turn it over in the first place? He went from defending his legal rights to looking like a complete moron.

Brady's team needs to come out about this phone thing fast.

I've read Goodell's decision. It's going to be fun hearing others as they find all the problems with it. I particularly enjoyed his attempts at staving off the NFLPA.

Don't mention any facts ,Deus...it'll get the whacked out wagon jumpers trying to jump back on. Let the ADHD riddled know-it-alls wail and moan about what a POS Brady is now. My take from what Goodell said today is "is anyone surprised?". He is going to be eviscerated by Kessler when it gets there.

I don't know why but I'm still in shock that 6 months later were still having to talk about balls that were slightly lighter. I mean this is what the country is worried about? It was the headline on cnn and why? Because roger upheld Rogers decision. So stupid. It truly does show how strong jealousy can be, they can't handle the Pats always winning so this is their way of taking them down. Noone will convince me if this was Carson Palmer or hell even Peyton this story would have been over a long time ago without everyone calling for their head!

Goodell = Crusader and true believer
NFL officers = Agenda carrying anti-Patriots personnel
Owners = Jealous people who don't grasp care that this could happen to them
Kraft = Greed over principles

Throw that all together, and you get this nonsense
