Breaking: TB12 Authorizes Federal Court Case!

Why would goodell after 6 months of all this stuff back down and reduce the suspension even if he was scared of court? It going to court 1 of 2 things happens, suspension gets overturned and he gets to turn around and say "hey I tried" or the suspension is upheld.

Really what is the incentive to wipe out the suspension? All he would get is get media backlash and we already know owners were pressuring him to keep it 4 games. Keeping it at 4 games and letting the court make the actual appeal ruling was always his best play from an image standpoint and we all know how worried goodell is about his image
I agree with all of that. But the post you were replying to said this wasn't the action of a league scared of court. It seems like you agree?

I guess I took it as more of a "nfl thinks they will win in court" kind of statement.

So Goodell withheld his decision until his lawyers could draw up the legal documents and file them simultaneously with the announcement of his decision, gee that sounds like the actions of a neutral arbitrator!

Brady really messed up by destroying the phone, no way around it, that was dumb, the NFL has no right to that phone or its contents, so destroying it was just plain stupid.

Any serious look at this case by an impartial arbitriator should kill the NFL's case and their backhanded rulings.

If this isn't enough for Kraft to call for Goodell's head, I don't know what is.

The truth of the matter is, when you "destroy" a phone, your cell provider still has record of all messages you send. yes, in a court case, they could subpoena cell and message records from 2-3 years ago. Unless you have a iPhone (which he probably does) and are using iMessage, in which iMessage encrypts all messages with a code that not even apple itself has. v

People are forgetting that all of the text messages are a matter of record with the phone company. Those can and will probably be subpoenaed.

They were already provided, a list of 10,000 texts and phone calls. The cell service provider also affirmed that the contents of those texts cannot be retrieved. This is all in Goodell's ruling.

this is according to douchebag tanguay

And Brady and his legal crew may not be able to get this into court. My legal source tells me destroying evidence will greatly damage his chances of obtaining the temporary restraining order needed to avoid his suspension and bring this case to court.

tanguay may want to never use that source again for legal advice

"Restraining order"? Seriously this guy is a complete moron...

FFS people, how many times has the NFL played us with some damning revelation (10 of of 12 balls etc). We freak out and it gets debunked later. Ya really think Tom would go to federal court if didn't believe he was not guilty?

I did that with a tv remote once.......must have been back when the Pats were doormats :(

Here's what I'm thinking: while the contents of the phone he used from November to February was not available, a complete log of who Brady texted and called was available. The NFL could see from this if Brady had ever contacted JJ or JM in some way that was somehow not on their phones too, as well as all other parties he contacted. In addition, his prior phone had all contents available, so... If the NFL thinks he's hiding something by destroying the phone, they should be able to point to a specific phone number that Brady had contacted as somehow suspicious. They can't just say "we don't know who he talked to, he destroyed the phone", because they do know who he talked to, and if none of them is reasonably suspicious, then this holds no water.

NFLPA claims that NFL received all the information they asked for. Which makes the cell phone report an even bigger red herring.

It didn't take Brady's agent long to discredit Goodell's ruling on the appeal and the sham that it was.......

Ya either he made that up or he needs new legal advice. #1 That person is basically saying because Brady didn't turn over his phone it hurts his chances of a court case. Well except for the fact that the nfl doesn't have subpoena power. Maybe a defamation lawsuit would get thrown out. But nfl didn't have any legal right to Brady's phone he can do whatever he wants with it. People are acting like he was ordered by a federal judge to hand over the phone but destroyed it. Nope, sorry that isn't the case.

Secondly the nfl were literally in court filing something when this was announced. If they are doing that then you can bet the house that they are expecting the case to be taken in Minnesota.

I've been waiting all summer for this.

I've already come to terms with the fact that most will never believe in his innocence, particularly with this bit of info. However an explanation from the Brady camp would sure be nice.

At this point beat the NFL, get on the field, play all season and win #5. That's all that matters anymore.
I'm not a lawyer but have been in courts for 30 years n have interviewed many many defendants. I'm guessing that upon advise of counsel he cannot say anything as it is not confidential. From a PR n fan perspective he certainly needs to. Legally, I don't think he can

Id feel far more excited about this if it weren't for the phone revelation.
I don't believe the phone revelation, i think goodell is lying again. If brady distroyed his phone it would have been brought up months ago, it would have been in the wells report.
