Why does Brady's phone matter at all in this case? Don't they already have Jastremski and McNally's phones, and therefore, any potential incriminating texts they could've had with Brady?
Because the average person watching ESPN will eat it up and assume Brady has something to hide. As Stradley says, it's a red herring.
 
If there were actual settlement talks don't you think th e players union knew aboutvthe cell phone? And if they disnans and still held their ground on no suspension or court then they must feel pretty confident.
 
Brady's texts are on a server where they've always been. If the NFL ever wins the chance to look for magic texts that didn't make it to J and M's phones that's where they would want to look anyway.

If they looked at Brady's phone and found nothing they would have just said "You must have found a way to delete them, we want the records from the phone company."

They know it, it's a PR move to make this into something. Now, watch me delete this post by destroying my phone.
 
People are forgetting that all of the text messages are a matter of record with the phone company. Those can and will probably be subpoenaed.
Phone company said they couldn't be recovered.

As I said the other day, the NFL is terrified of a court case. Their filing just about put it in skywriting.

If the NFL is terrified of a court case they wouldn't have given Brady any games.
 
I imagine a billion dollar company has some legal connections. If NFL goes to NY and NFLPA goes to MN, who decides where it ends up?

BTW, Don Yee brings up the fact that they provided all the Electronic Data from Brady's phone. The phone shouldn't matter.
 
nfl's tactics say otherwise.
The fact that they knowingly gave Brady false info and lied about foreknowledge of Indy's complaint alone are pretty strong indicators of abuse of process.

That doesn't make sense in my inedcuated opinion. NFL is filing for a case that doesn't exist yet?

The phone mattered not at all since it ARGUABLY contained nothing relevant. What is relevant is the request for the phone, the four month refusal (much of this after the phone had been destroyed).

Perhaps a court will find that Brady not violate league rules by destroying the phone. The HOPE here has always been that the worst court result would be to reduce the penalty for not cooperating to $50K, the "called for" penalty for such action.

Sounds like Brady gave all his info to Roger...yee said he gave a lot of electronic info more than he should have to.

If the NFL were afraid of a court case, then they would have reduced the penalty for 4 games to $50K.
 
The complaint asks the court to confirm the arbitrator's award under the LMRA. They want the case venued in NY. No judge assigned yet.

Pretty sure that the CBA has stipulated that they are supposed to be in MN.. Could be wrong though..

Goodell also has to answer to his bosses. He put himself into a no-win.

Damn, it didn't work. Almost as if the device I view the text through doesn't have the ability to destroy the information. Too bad I wasted a phone to figure that out.

A complaint seeking to confirm the arbitrator's award. That usually happens when you want to convert it into a judgment. Here I think it is more about getting some "advantage" in deciding where the case is heard.

If they weren't afraid, they wouldn't be asking a court to please, please don't let them sue us.
