How I Feel - MERGED (by accident - Ian) Brady Suspension Upheld

It will be beyond humorous if the Brady team uses the Wells Report to defend themselves in the case of the destroyed phone. Wells and Goodell said that a transcript of the electronic correspondences related to the case would have been fine with them. Bill Polian just said the same. It would be an absolute riot if the team actually provided such transcripts.
 
I would have purposely destroyed it for exactly the reason I already have given. I don't want people prying into my billion dollar personal life.

Which would have been a terrible decision when you can just give your phone to Don Yee or whoever to hold onto for as long as necessary. It's not like his options were limited to "expose everything to anyone who asks" and "destroy the phone entirely."

That said, I agree with you that it is largely a red herring. If it were as compelling legally as the league is painting is as being in the court of public opinion, the decision would have come weeks ago.

The extent to which Tom opened up his private life to the Commissioner will become clear in the coming days.

As Mr. Vincent testified, the ball never got into the game and the matter 'was addressed immediately.'" (emphasis Goodell's).

You could say the same thing about BB during Spygate too Omissioner.
 
Brady needs to be suspended for shear stupidity.
What moron A) destroys his cell phone when there was zero need to do so and then B) confesses to it.

Why would they even need it? They can get all of the communications from the providers. We have now gone from mere weapons-grade stupidity (HT to another poster) to galactic stupidity.

You can't get it from the providers. There's a thread in here that shows the content of texts disappears after a few days.
 
Yee with the long-awaited "privilege" argument as to why this whole thing was NOT independent. Good start.

Most explicit thing out of the response is the complaint that they only had 4 hours to mount their defense, and thus why 'important witnesses' (Dorito and Dink) were never called to testify. If they follow up on explaining the phone garbage, then this is basically the millionth repeat of the same sorry cycle that's summed up this mess: NFL makes an outrageous claim; team Brady provides sanity. Something has to give.

If Yee has that phone, then Brady has to give it up in a court of law, if the judge approves it as evidence.

If the phone doesn't exist, however, there is nothing anyone can do about it. It is not considered destroying evidence. This is why Yee might've even advised Brady to destroy it after Yee wrote down relevant material in transcripts.
 
Like personal things???? I wouldn't trust the NFL either and I'd destroy it before handing it over....
Brady was NEVER going to have to turn over the phone. He didn't need to.
NFL has zero subpoena power so there was zero chance he ever had to turn over his phone.
Just shear stupidity that he destroyed that phone when he did.
Brady will NEVER get his reputation back after this.
What a naive fool Tom Brady is.
 
The NFL has lied, or misled, about every finding up to this point. I find it both comical and pathetic that people are still willing to buy into the NFL's take on anything, and the fact that they are willing to do so about something that is so clearly aimed at PR is a really sad reflection on human wisdom.

People throughout the country are swayed by the 97% consensus of the mediots that the Pats cheat

How easy is it to get private conversations from a provider? In other words, how much interest would a judge have to compel a provider to give those over?

So do I as you can easily lose track of phone that is no longer used. Destroying it protects the privacy of everyone that has ever emailed, texted or contacted you.

Understandably it is the timing of the destruction of the phone that has raised questions.

But as I've said before, no matter what or why he destroyed his phone the science still stands.

Note:

The NFL's decision to file in NY sets up a likely venue battle. Why do I call this a note?

It likely delays any final decision on the case even longer, meaning that, if Brady gets his initial injunction, this case becomes that much less likely to be finalized in the upcoming season and Brady is that much less likely to serve any suspension during the 2015 season should he ultimately lose.
