They are saying that he did not destroy the previous phone he had before the one after it that he did destroy - - thus putting to bed his contention that he always destroys his old phones.
Because what else should he do with it? Sell it and take the chance that the data on it can be recovered and end up on TMZ and all over the internet? Do you think a guy that makes millions cares about a phone worth a few hundred bucks? I destroy my own used phones and hard drives. I recover lost data as part of my business, its trivial. I'm no body and most likely no one would ever take the time to recover my lost data. But TOM BRADY? I'd attempt to recover his used cell phone data if I had access too it? The data/photos would be worth a fortune if someone had access to him
From a security stand point he and any high profile celebrity is smart to do this (assuming they are destroying them beyond all repair).
And as for why he told them? Maybe because he's honest and doesn't feel the need to lie?
I think Brady's team was trying to be helpful by providing the cell phone data from his previous phone. Therefore they had to explain why they couldn't also give them the data from the the phone he "destroyed"you misunderstood my point. Why tell them? just hand them over your current phone that doesn't have any framing texts (if there were such on the original phone). just give them your current phone and have them assume it's the only phone you've used in the past 100 years.... they won't know the difference anyways. why mention destroying in the first place? you know they'll use such garbage against you! why tell them you destroyed?

He also talked about why he believed it is different from the Favre thing, the Vikings/Panthers ball warming thing, and Rodgers's talk about trying to slip balls past the officials.
Off the ledge people. People are way overthinking this. Loss of the phone would only affect a civil trial for defamation etc... The issue at hand is unfair labor practices and the NFL has no right to the phone to begine with and the only evidence the NFL can produce is that in the Wells report.
