Lupica: Roger Goodell in a battle he can't win

Actually, Lupica is very much saying Brady has not been proven to have done ANYTHING wrong in Deflategate several times in that piece. Lupica slams Goodell and the NFL unequivocally now. This is a sea change for him.

Goodell is now on no position to punish Brady and come out in one piece. Lupica, Sally Jenkins, Peter King and Mike Florio are all firmly on one side of this issue.

It is truly sad that where the media stands should have any bearing in any issue, yet it absolutely does. Most decisions that are made today are media driven, from trivial crap like .4 psi I a football to policy decisions that impact all of our lives every day....... <sigh>
 
I don't think the Patriot team penalty of lost draft picks and fine go to court....It would be nice if the court vacated the Pats penalty but don't think it's even possible.
 
I wonder if goodell is even smart enough to regret getting into this mess in the first place.

Does he lie in bed at night wondering "Why did I ever get involved in this fiasco? All I had to do was to issue a correction to the bogus reports about the ball pressure the day after the AFCCG and this would've been over in a day. What was I thinking?"

I doubt it. His incompetence is exceeded only by his clueless arrogance.
 
Goodell and the NFL have already won.

The NFL wants to keep the majority of its fans happy and paying to see games and Goodell wants to strengthen his hand against other players in the future.

If one assumes that the NFL wanted to level the playing filed by crippling the Pats, delaying this as long as possible is the best strategy. When would be the worst time for Goodell to announce his decision to keep the suspension?

What if he waited until the last few weeks of the regular season? This would really distract the Pats for a long time and BB would have to keep his quarterbacks up to speed and therefore not able to practice plays as much as they could.

Goodell's handling of this and other NFL player penalties will help him keep control in the future.

Fear and intimidation goes a long way and his handling of this and the other cases promote fear and is intimidating because:

1. No player can predict what penalty Goodell will administer for what ever penalty.

2. Since 4 of the Colt's footballs were also under inflated and this was ignored by Goodell, no one can predict what penalties he will or will not enforce.

3. Since he changes his mind on penalty enforcement based on the reaction of the crowd, no one can predict what the penalty will be until he has tested the fan base.

4. He now knows that more than enough people will not investigate his methods, actions and judgements so he can continue doing and acting as he has been.

This it is great for him.

What team or player would want to try to argue with the one man that can control information flow, knows people will not check him and is judge, jury, executioner?

If he loses in court it has not hurt him before and it will not hurt him this time either.

No matter what happens with this event both the NFL and Goodell win.

Is it a "win", really? In the long run does sacrificing competitive integrity to create a pro-wrestling, Harlem Globetrotters, sports-like reality TV entertainment business model really pay off?

Real fans of the game will eventually tune out. The 1/2 wits who enjoy this kind of stuff may become bored and switch over to "dancing with the idiots," "cupcake wars," or whatever such tripe people watch these days.

But, he still believes the ball boys let air out of the footballs. How can so many knowledgeable media members not know the Patriots defense is that the balls were not deflated AT ALL.

I believe that there's language in the CBA that says that the decision from an appeal must be made in a reasonable amount of time. I'm guessing that waiting 6 months to decide an appeal that took 1 day to hear would violate this agreement
 
Here's what I got from this article:

1. This is going to Federal court and the suspension to Brady WILL be lifted. I no longer have any worries that Brady won't be on the field for the first game. When the idiot mediots are climbing on this bandwagon, the court case and the win seems more inevitable

2. It has become abundantly clear to me that the ONLY way for Brady to truly clear his name and expose the truth of "framegate" is with a defamation suit. Winning the appeals court case ONLY gets him back on the field on time. If that is where it ends, Goodell still wins.

The only way for Tom and the Pats to reclaim their honor is to go to a court where they would be allowed to show the bad faith, the bad science, and the malice by the league in open court. That is NOT going to happen when the NFLPA takes this to court. The ONLY thing that that inevitable win does is show that the league didn't follow the CBA correctly in handing down the punishment.

The fact that Brady was willing to allow the NFLPA to even make that attempt at a settlement makes me very scared that after his victory in Federal Court he will walk away from the true battle that NEEDS to be fought,

3. I was happily surprised to learn that Brady's jersey is the biggest seller so far. A lot of Pats fans have voted with their dollars. If only the owner was as loyal to the truth,
 
Lupica read Sally Jenkins and wants in when Goodell gets stomped by Brady. Guy is a total phony, but anyone going after Goodell is a good thing.

One of the board lawyers can educate me on this: Would that info also hurt a potential defamation suit should Brady choose to file one? Do you have to show tangible damages in order to win defamation, or do you just have to show malicious intent?

He doesn't recieve any of the proceeds. I forget the term, but his marketability rating, or draw for endorsement advertising went from the top ten in sports to the cellar. If that's not damages I don't know what is.

Read that paragraph again.

I did not interpret it the same way you did.

In fact, he seems to be saying that believing that story is akin to believing the bad science of the Wells report.
