He should even go one step further. Create a copyright on his name and likeness so it can't be used without his permission.

Granted, it will never fly and I'm sure the NFL has all the rights to that (via CBA/contracts), but perhaps it can be held up enough to make it inconvenient for both ESPN and the NFL for a few weeks.

It's not a copyright, it's a trademark. And the CBA addresses such things anyway, so the whole thing is a no-go.

Right - trademark, thanks for that.

I guess what I'm trying to get at (and I mentioned I know the CBA covers it). But, I'm looking at ways Brady can make the NFL uncomfortable and perhaps accountable. I assume there is some measure that they use his name/image/likeness in a manner that is used in a positive way. As stewards, they should not be doing things that lack integrity and cause damage.

Perhaps he can come at them in different ways and use that to get after their communications and prove their wrong-doing without going through the defamation route. Though, I;m sure Brady and his lawyers could more easily find cracks in any legal doctrine that I could. Or perhaps, Brady just wants to get his games back and move on (most likely as he probably doesn't want a protracted fight).

More selfish on my part for wanting the people running the NFL to be exposed for what they are. However, the longer they wait, the more time the NFL has to clean house and get their stories straight.

I think we can all agree:
  • The league has a legitimate right to use Brady's image for promotion.
  • Subcontracting from the league, so do many other organizations, including ESPN.
  • Separate from that, news organizations have the right to use Brady's image when reporting news about him.
  • The league and/or ESPN have defamed Brady. (The only way Mort is innocent of defamation is if league sources set him up.)
I don't think the bad guys, when connecting Brady's image to his defamation, are doing so in a way that misuses their promotional rights to his image. They're just defaming him, and in some cases including legitimate-news-style use of his image in the defamation.

I haven't watched espn in a very long time. to be honest. I don't miss any of it. its absolute garbage. if it wasn't for this site I wouldn't have any idea what is going on with that pathetic station. seriously if you don't like espn just don't watch' its that simple. you can do it.

I don't disagree with a thing you said here and, obviously, didn't state what I was aiming for in an easy to understand manner.

ESPN does not give a ratz azz about Patriots fans, they are trying to appeal to a wider, dumber base to increase their ratings...

ESPN is not as much about sports as it used to be, but more about dealing with a sensationalized news bites for people with short attention spans.. or those who do not think.

Can you image the media coverage ESPN will get from Foxboro....nothing, zilch, NADA....nothing but scorn and contempt...I can't wait, from Brunell to Jackson to Mort to Wilbon to Bettis to all the ESPN New York staff....don't know how they can ratch it up any more other than saying flat out they hate this team....

The guys on "highly questionable" just mocked goodell playing god and literally all three laughed at the wells report. I'd say the tides are at least stagnant, if not slowly changing.

ESPN is no different than second hand smoke, the long term effects are detrimental to your health and wellbeing; short term effects include nausea, diarrhea and the inability to conjugate anything but a verb.
I resent that statement. 2ndhand smoke has no proven negative health effects.

At least that's what the fellas at Exponent say, so it must be true......

I appeal to your integrity....

I've actually already reduced visits to their site to about twice a week. Time to just avoid them altogether.

I got a better one, how about "softer than a Colts run defense"
I just saw a mini-segment on the NFL network on QBs. They had a few on there, no Brady, but you got the somewhat known-famous Peyton yelling "Omaaha".

EDIT: This sounds overly harsh, but I'll keep it
Maybe next year Brady should come out with a new code and call it "Disney" :D. It could implode the internet. Would Omaha, due to Peyton's use, be the national capital for one and done?

I do like Peyton as a QB, not sure as a person (seems good enough), but really can't stand the media's version of him being the greatest.

I'll take the ribbing .....and the Lombardi's too, Thank you very much. Every year we hear the same 5h!t . "The Pats wont make the playoffs, Andrew Luck rules the world, they have no secondary... Blah, Blah...." Watch out MFers. TB is in rare form. And he will once again prove "DONT **** WITH ME!!!"

Cable is a lumbering dinosaur right now. With more and more people "cutting the cord," garbage like ESPN will eventually be tossed into the "dustbin of history" where it belongs.

Espn is a NY network as far as I am concerned. Not surprised.
