He should even go one step further. Create a copyright on his name and likeness so it can't be used without his permission.
Granted, it will never fly and I'm sure the NFL has all the rights to that (via CBA/contracts), but perhaps it can be held up enough to make it inconvenient for both ESPN and the NFL for a few weeks.
It's not a copyright, it's a trademark. And the CBA addresses such things anyway, so the whole thing is a no-go.
