here is how this should play out in a court room, in front of a neutral judge.

To the NFL "Please show me the recorded measurements of all the Patriots balls prior to kickoff"

NFL "we don't have actual recorded records"

Judge "well then how can you actually know if the balls deflated or not?, Case dismissed, all punishments against Brady and the Patriots must be removed."
 
"Fair and open" process? I guess he could theoretically debate that this process has been fair (and he'd be wrong), but on what planet is this 'open'?
 
Few things happen quickly in the government or court system, but injunctions are one of them. They're fast as deliberate compensation for everything else being slow.

I have to say that posters on this board believe that they represent the patriot fan base when they really do not.
Back in May I was at a birthday party for a good friend who is also a season-ticket holder. While there, I ended up talking with other people from our tailgate who have been season-ticket holders Longer than the birth of many who post on this board. Although disappointed with Kraft's pronouncements they fully intend on going to the opening game and we're trying to convince me to go.
The opening game will b a sell out.. Brady or no Brady as well as will every other home game
I don't doubt that people will be going to games but that doesn't change the fact that Kraft has gone from the most beloved owner to a subject hate and ridicule by his actions. we will just see what type of reception he gets on opening night especially if he is chatting with his good buddy Goodell in the owner's box.

Absolutely. From over-punishing Brady on the basis of a shoddy, biased report to declaring himself arbitrator of the appeal to purposely delaying the decision, it's painfully obvious that goodell's only goal now is to screw Brady.

He's not even trying to hide it anymore.

Kraft is no dope. He is doing what's best for HIM and his cronies. We are secondary. You know, the ones who pay him!! He's just greedy.
 
He should never have heard the appeal if he didn't have ability to make a quick decision.

The sad thing is most of the country thinks Brady is guilty because its implausible that a league office would be so vindictive -- and yet the implausible is happening.

Not necessarily. There's a doctrine known as "ripeness" (as for a banana). Courts will generally avoid taking on litigation based solely on theoretical rather than actual damages.

If Tom is about to miss a game, then there are threatened actual damages sufficient to justify an injunction. Beyond all of the other damages he'd sustain, he'd lose money. And even if $500k is relatively not that much to him, the judge isn't going to question the dollar amount. He'd lose a portion of his salary. The greater concern, I think raised by Furhrer Goodell's most recent comments, is that the appeal may not be decided with sufficient time (e.g., a day or so before the start of the season) so that the judge would literally not have the time to enter an injunction. There is zero doubt that Brady's team has a document ready to be filed at a moment's notice, and probably multiple iterations thereof depending on the specifics of the Fuhrer's "decision."

Kraft can negotiate until he is blue in the face. That will have no impact on the NFLPA's position, nor Brady's. Even if Kraft "negotiates" for a 1 game suspension (which despite his pathetic effort to stand up for this team thus far, I do not believe he is attempting to achieve), Tom doesn't have to accept that.

I do not purport to know Brady's strategy. What I do know, as I wrote, is that Kraft's decision and strategy do not necessarily have an impact on those of Brady, who is free under the CBA (with some exceptions irrelevant to my current point) to pursue whatever course he wants.

What would possibly make you think Kraft is doing anything to help? He REFUSED to testify as a character witness for Brady at the appeal. Please stop making up pretend things Kraft might to do that make you think he isn't what he is.

As a go-to-hell shot across the bows of the good ship Brady-NFLPA, that he can wait til 1200 on 9 sep to announce that he has denied the appeal, thereby leaving them little-no time to file for an injunction.

Roger's stupid, but not that stupid. Only the most ardent of Patriot haters could see that as something impartial.

To tell you the truth from my perspective this has been deliberate and calculated all along. Can you remember the last time the NFL stayed in the spotlight all summer long with such national attention? Sometime around beginning/mid-August when camp is boring and the sports worlds spotlight is beginning to get focused elsewhere (baseball) is when Roger takes it back.

Nothing says "Hey, look at me!" than a good old-fashioned League vs. The Champions controversy.

It almost feels scripted.

As soon as the chance of the Patriots, once again, making the Super Bowl became a reality, our good buddy R Stokoe Stalin fell right back into the exact same pathology he has exhibited since taking over in 2006...the pathological need to enforce parity within the league using any means at his disposal.Absolute dictators don't have a sense of right or wrong, they only operate on the "my way or the highway" axiom...right or wrong. This crap will not end until HE is removed...and at this point, he's dug in like an Alabama tick on a coonhound's neck.

Not to be facetious, but what, exactly, would have been the point of Kraft's "live" testimony—rather than the affidavit he did send—especially given that the arbitrator is Goodell? How would his being there (remember, he was on the pre-scheduled trip to Israel when the appeal took place) have made any difference?

You are joking right?
Brady asked him to be there. He said NO. (The flight landed in time by the way)
Brady asked him to testify by phone. He said NO.
Brady is fighting for his reputation and the owner of the team, you know, the one who accepted the penalties, causing many people to think that was an admission of guilt, REFUSED to testify.
Kraft was asked to testify to show support. He declined to show that support, completing the slapping in the face of accepting the penalties in a speech that never mentioned Brady's name, answering the question of whether he hoped Brady would be there opening day by saying he 'hopes everyone who deserves to be there is' and then by abandoning him when he requested Kraft to be a character witness.
How would that have made a difference? It would have made a world of difference. As I sit here I see Kraft going out of his way to not support Brady.
