As a go-to-hell shot across the bows of the good ship Brady-NFLPA, that he can wait til 1200 on 9 sep to announce that he has denied the appeal, thereby leaving them little-no time to file for an injunction.

Or does anyone think a court would take a preemptive injunction filing before the appeal is officially denied?

"There is no timeline. We want to make sure we have a fair and open process," Goodell said at the TRIPIL fundraising luncheon.

Brady’s appeal was heard on June 23 and lasted 11 hours if you count the one hour lunch break. There’s a lot riding on this decision for the Patriots and their quarterback. As of right now, Brady will miss the season-opener on Sept. 10

An interesting point. I think, under the circumstances, they might actually be able to get an injunction for the first game if Goodell were to wait that long. Technically, though, he's not suspended until the appeal is handed down (i.e., if Goodell were to wait past the season opener, he'd be able to play).

I don't think the article is accurate. Brady can file and injunction to delay the suspension regardless when Goody rules on the appeal. Depending on the court/judge I guess is what would determine how much weight they give the CBA and it's process. TB12 and the NFLPA could argue that by delaying, the NFL is not operating in good faith.

At the end of the day, Brady has a right to earn a wage and the NFLPA has a damn good case in demonstrating that the NFL has unjustly denied TB12 that right on a number of levels.

I really, really, really, really hope the NFL blows up over this. It's looking more and more like Goodell is really acting in bad faith; not mere garden variety incompetence.
While i certainly see where you get this (and I think we'd all agree the PATS are getting shafted by the gutter-rat brigade - namely the NYFL*).

Let's wait and see when they announce the decision before getting all worked up. I'd have to say even Goodell couldn't be that (un)clever and it would certainly make Brady's case that much stronger.

Even better (if he did such a tactic) would be the judge making Goody demonstrate (in court) that it really took all that time to make the decision.

Not necessarily. There's a doctrine known as "ripeness" (as for a banana). Courts will generally avoid taking on litigation based solely on theoretical rather than actual damages.

Doesn't he already look that way (to any semi reasonable objective observer)?

To me this is his poker equivalent of pushing in the chips and putting on the sunglasses, daring the other guy to match while he is hoping the guy'll fold because he only has 1 pair.

It this comes to pass and Goody decides to wait until the 11th hr of Opening Night, in his injunction, Brady will argue that this particular issue became "ripe" once Goodell suspended TB12 for four games on charges that are completely unsubstantiated or proven.

The back-room discussion preventing this from happening is TB12 threatening to sue the NFL for unjustifiably denying his right to earn a wage.

How long could Goodell possibly hold out? Opening game day? Kick off time?

I suppose Brady's lawyers can always file an emergency petition if Goodell sits on his hands until the last minute but the courts will need SOME time to issue a ruling. I concur that if Goodell does try something cute like that it won't play well in court but I'm guessing that his legal team would advise against him trying something like this.

Kraft has looked like a gutless turd ever since he bent over and took it from Goodell and didn't fight the ridiculous punishment Goodell imposed on the Pats.
 
It is so incredibly obvious that Goodell is just stalling. Hoping that circumstances become more favorable for him to make a ruling. It's insane he's allowed to drag things out as long as he wants without the media killing him for it.
 
I hope all our fans shower Bendover Bob with a chorus of BOOS on opening night.

Honestly, I'll be a bit disappointed in our fanbase if we don't. He deserves every jeer he can get.

He's turned this team, our fans and our greatest player (the one who made him into the rich and powerful man that he is) into a proverbial laughingstock.....

I just saw that the gap between Brady's appeal and a decision is currently 2nd longest in NFL history. The bad faith being shown by Goodell is becoming apparent even to the haters.

BTW- the longest gap....so far, was Greg Hardy's coming during a time when Hardy was already sitting out the rest of the season after news of his behavior was revealed.

I have to say that posters on this board believe that they represent the patriot fan base when they really do not.
Back in May I was at a birthday party for a good friend who is also a season-ticket holder. While there, I ended up talking with other people from our tailgate who have been season-ticket holders Longer than the birth of many who post on this board. Although disappointed with Kraft's pronouncements they fully intend on going to the opening game and we're trying to convince me to go.
The opening game will b a sell out.. Brady or no Brady as well as will every other home game
 
Goodell wants Brady to play in the opening game - he wants the showpiece with the banner etc.

He'd then like to ban Brady for 4 games.

This could rumble on!
