Time For Brady To Capitulate And Move On

I keep hearing this argument, but I don't buy it. Al Davis didn't 'undermine' the NFL. Al Davis' victory over the NFL actually led to other owners moving and getting better stadium deals for their teams.
I don't know if these is actually true, but I heard someone on either radio or tv yesterday saying that after the last time Davis sued the league, all the owners got together and made an agreement that there would be no more of that and it hasn't happened since.

FWIW.

Yeah, they changed the rules. The thing is, though, that only the government can actually make itself impervious to lawsuits. For any other person/entity, even the most theoretically airtight non-suit contracts can be tried in court.

Now starring as Neville Chamberlain in the hit NFL musical "Sure Adolph, Take All Of Europe And Russia Too!" it's our own home schooled Bobby "By The Lake" George, here to calm the waters and re-instill trust in the pristine values of the NFL.

What a show...a boffo smash hit SRO destined to sell out in first run venues like Cedar Rapids, Iowa and Butte, Montana

I was actually thinking that an agreement like that -has- to be legally tenuous in terms of things like antitrust, no?

Look, tripe like this slapped together and put out there by a "Patriot fan" smacks of deliberate agenda driving...as in Kraft and minions reaching out to a local catspaw to promote their specific agenda. This isn't the first time we've seen George write these type of pro-Pats mgmt. lollipops.Speaking for myself, as a life long Patriot fan, I DO NOT want Brady to lay down for any reason. This season is half-ruined as it is because of the blatant capitulation by Patriots mgmt. I feel no need to show Kraft any allegiance or trust...he's gotten RICHER off me and millions of fans just like me. This whole farce is a direct slap in MY and ANY other rational human being's face, an insult to our intelligence. You said your piece Kraft, you made your bed...now let us, the fanbase that feeds your voracious pecuniary appetite, get some justice out of this overt, criminal sham of an "investigation"

Well, the leagues do get some antitrust exemptions through congress but that doesn't cover everything (and I don't know that such would apply here, so I'd have to look into it). An unconscionable contract, or a contract deemed against the public interest, for a couple of examples, won't survive judicial scrutiny.

Example of one where public interest leads to one being held as unenforceable:

Example of one where contract was struck down (well, partially, but I'm not going to worry about that since I know you get the point):

Those are tough wins, but they do happen.

To me, it was just an absolutely absurd article, and the last paragraph sums up the blithering stupidity:

Goodell cannot capitulate. Brady must.

As stupid as posts get around here, it would be tough to find one to top those two sentences for sheer idiocy.

Yeah, they wouldn't let him sit at the cool kids table in the cafeteria.

I think we may be onto something here. Is Kraft's middle initial G? Maybe Bob George is just a pen name for Robert G. Kraft. How else could Ian justify putting this crap on the Patsfans site?

Seriously Ian, how can you justify it? I and many other Patsfans on here can write better than this guy, who has trouble completing sentences, and we can write more intelligent articles. Why don't you give him his walking papers and try one of us.

As a Pats fan I shouldn't be reading bait articles that are designed purely to enrage and agitate a fanbase that's already put up with more spurious, inane **** in one summer than any other sports team on the planet. That should not be this websites role.

Heck, even the following would be an improvement:

@JoeSixPat Al Davis sued the League....and his franchise seemed to do just fine

Hah! Well done!

Yes - the Raiders are indeed the shining example of what a quality franchise is all about!

Hey - if there's Patsfans who wanted to see Kraft lose a $1.2 billion lawsuit like Davis did (and that was what, the mid-1990s?) and think that has no impact on the organization - or think that the NFL losing it's anti-trust exemption has no impact on the Patriots, that's fine

But Davis' issues regarding location of franchises is one thing - Kraft was looking at undermining the legal aspects that have helped make him and every owner billionaires

Honestly I don't know all the ramifications of what a Kraft led lawsuit against the NFL would mean in terms of unintended consequences - but as you note so sardonically well, the Raiders are a joke of a franchise and that's the LAST example I'd want to see the Patriots folllow

The point is Kraft at the very least could have simply said nothing, kept his stupid mouth shut. But he not only didn't defend the team but he defended the league at the expense of our team and told us fans that it was for our own good. That's unforgivable.
Yep. That’s the most aggravating thing. Absolutely zero reason to announce he was giving in.

I've known Bob George as a Pats fan dating back to the old Patriots mailing lists in the 90s. He's a Patriots fan as much as any of us.

Just because someone disagrees with you doesn't make them a troll.

He makes some valid points, such as:

Most people are under the false impression that a federal magistrate or arbitrator can rule on Brady being innocent of deflating footballs, causing such action to happen, or his knowledge of such activity. The feds won’t meander into that area at all. Where they have jurisdiction is whether or not the CBA was breached. - See more at: http://www.patsfans.com/bob/article...late-and-move-on/?sc=rss#sthash.44SpkyCS.dpuf

This is a big deal and I think a lot of people have missed and continue to miss it.

I disagree with the article though and I think Brady should never give in because that is essentially admitting to cheating. Brady should fight it until the bitter end and I don't think he should threaten lawsuits I think he should pursue them because that's the closest he'll ever get to clearing his name because, as I understand it, the science of the report could be brought under scrutiny in civil court.

I've read this guy's stuff before and it always strikes me as so long-winded and stupid that he must be paying PatsFans.com by the word to print it. And, BTW, who the hell is he anyway?

This zeal for censorship needs to stop. People really need to knock that **** off, and I'm not just talking about one article or one Patsfans.com contributor. I'm talking about in general.

Having said that, I'm still hoping for an answer. Does anyone besides Ian know who the hell this guy is? Is he a poster who took on the role, or what?

Also, for all those crying for censorship here, how about you dedicate yourselves to writing full articles for Patsfans.com, so we can get the opportunity to skewer your offerings?

It was a bad article (maybe one of several - I cannot say many of the articles read as more than opinion pieces). The simple remedy is don't read it if you don't like the author. Don't kick the author out because the article is bad.

I also would favor other contributors offering up articles. Not in the 'skewer' line of reasoning, but rather because some posters here likely could offer quality work in more substantive pieces. I don't really grasp why certain people become the site authors.

And yes, it is always easier to criticize than it is to author.
