Official Brady Appeal Thread: D-Day Tuesday June 23rd

That's what the Appeal will come down to. The texts, the long phone call and the meeting in the QB room. He has to convince Goodell that there is another explanation for all of that other than that TB knew about activities that broke the rules either before or as a result of those events.

Wait why does Brady have to give good answers about the texts? He wasn't involved in any of the texts and if he never told them to do it then he shouldn't be answering about texts he had no involvement with.

On the flipside of that Kessler and McPhee will have a field day with teddy wells and why he decided to ignore the text that said the refs over inflated balls and that Brady told them to bring the PSI rule and show the refs.

they are going to question him extensively about the texts. he better have good answers.
Since science proves nothing happened thr truth wouldbe a very good answer

Actually, there's one kind of circumstance under which Brady might agree to a game of suspension in a settlement -- if part of the deal is to drastically reduce the team penalty, along with the league issuing a statement sharply circumscribing what the penalties are for.
  • Non-cooperation? Unfair, but it can be a good business decision to settle about it.
  • McNally taking the balls out of the referees' locker room? Technically, a violation.

If the league is clear that that is ALL the penalties are for, a settlement could actually happen.
Taking a game will go dowm on history as an admission of guilt no matter the rhetorical structure of the 't statement.
This is Tom Brady who says he doesnt want to miss a snap in practice because thats how he got his job. he wont accept missing a game.

Schefter says Brady is testifying under oath.

Good. Maybe that means Wells does too, and we can find out why he didn't properly investigate the "11 of 12" leaker
No kidding. Depending on who is in that room (Kensil specifically) there are a few choice questions that I would want to know the answers to.

Brady sent texts to Jaz. It's reasonable to ask TB12 the context around those texts.

What ever happened to doing the right thing?
People keep talking about what Goodell should make up in order to look good. Why not just tell the truth and admit Wells did a terrible job and there is nothing to support his conclusion.
I dont understand how people think Goodell looks better by lying then losing on court and sayong he tried to screw Brady but the court found the truth,

The idea that Goodell would do the right thing because it's right has not occurred to anybody who's watched him for any length of the time.

I am a little stunned that he is under oath.

I think he is innocent of actual wrongdoing, but this just surprised me.

you'd have to ask the same question after he paid $5M for the Wells report

the man has a knack for driving these things into walls..........arrogance, I guess

the only thing that would make any sense today is an offer by goodell to remove the suspension and fine brady for not cooperating
So agreeing with a clearly wrong report so you pay for something that is wrong is better than using it to get the right result? He didn't pay Wells to make his decision for him. He paid him to investigate. If the interpretation of the investigation is science proves mothing happened why is that a waste of money?
Wells does not understand the science, doubling down on that is throwing away 5 mill

Some comments on the comments.

1. My biggest fear is that Goodell drops the suspension to one game and Brady accepts it. If that happens Goodell comes out a HUGE winner. Brady, by taking the one game suspension admits some culpability, and his legacy will always be linked to deflatgate rather than every other great thing he's done for 16 years.

Goodell gets that plus screws the Pats out of 2 draft picks including a #1. If Brady isn't exonerated by the appeals process he HAS to take it to court. If he doesn't, it will rival Kraft's acceptance as a near total sell out. It will be a decision he will regret for the rest of his life.

2. The Press has staked its position long before these hearings and has remained constant. Volin and Shaunessy have been consistently negative, while guys like Curran and Chatham have struggled to stem the tide of the NFL PR machine. We shouldn't be surprised by what they say now.

3. Every thing I read these days point out how flawed the NFL report has always been. Its been a case of pure slander from the start. It only goes to show how effective a concerted, well funded PR campaign can be, when that campaign can convince the vast majority of the NFL market that the mere POSSIBILITY of lowering the footballs 1-2 PSI is the same as level of crime as betting on the game or paying off the officials.

4. I'm surprised so much attention is given to this charade. It's not like anything new is going to be presented. We all know now what Brady's case is going to be, just like we know the League's position. Parading Brady in front of this kangaroo court/Soviet style show trial, is really a waste of everyone's time, as both sides are merely going through the motions.

5. Here's my prediction: Goodell will drag this out for most of the summer. In other words, NO decision will come from the league until the end of TC. Then with the pressure of the season hard upon the Pats he will offer what seems to be a concession by lowing the suspension to 1 game. If you are thinking only of the short run, it will be very tempting for Brady to accept this result. Especially given what we know now of the owner's mind set.

I pray that he thinks about the long term effect on his legacy.

EDIT: Already posted

This should mean that everyone is under oath, I can't see Kessler allowing Brady to testify under oath but not ensuring everyone does. I have always believed that Brady never told anyone to doctor the balls after inspection so his testifying under oath is fine with me, he would have had to do so in court anyways so I don't see the problem with it. If anything this puts more pressure on Goodell in his decision because if they don't have proof he is lying they are going to have to accept that he is telling the truth. I hope like hell that Kensil is questioned under oath.

So TB12 is testifying under oath. That should tell you something. I wonder if Teddy would have the ball sack to do the same?

Now I know this isn't gonna happen but this is silly season so what if Brady's lawyers are able to show that science proves the wells report was flawed. And let's say it is proven in a way where they corner wells and he acknowledges that he hadn't noticed the flaw. What would the outcome of that be? Wells is there today and science doesn't lie so I'm just curious if they prove there were mistakes and wells actually acknowledges that in front of Goodell what would Goodell do? As I said wells seems like the kind of person who wouldn't be honest with himself and acknowledge a mistake if it was presented to him but I'm just curious what would happen?

This is so historically stupid it's absolutely mind boggling...

- Possible low air pressure in footballs, during a game in which "properly inflated balls" led to a blowout.
- A "full investigation" over a slight decrease in the air pressure in footballs.
- A $5 million-dollar report over air pressure in footballs, to which there's no conclusion and more holes than a pound of Swiss cheese.
- The largest fine in the history of the National Football League is thus levied, over possible "low air pressure" in a blowout game, and a 4-game suspension is handed out to one of the greatest players to ever play the game and a face of the league, due to "probability" and a text message from two average joes from May 2014, which is, you guessed it, well into the previous offseason.
- The $5 mill report is torn to sherds by multiple reputable outlets, but no change in any suspension or fine.
- An appeal is called and the player in question, is called to swear under oath, over possible low air pressure in footballs in a blowout football game.

Honestly, will history show the moronic stupidity of this entire situation?

Not that I expect Goodell to be rational but what if the suspension is reduced to a game, the league will save face by saying he's clear of cheating but not for the non cooperation thing...and then in the 2015 season when the NFL finds that all footballs act the same way under the same conditions, the Pats get their draft picks back?

Think Tom would take that deal "for the team"?
after what kraft did in rolling over i doubt brady would 'take one for kraft and the team. By rolling over gutless bob threw TB under the bus, it implies bob didn't believe brady.

Under Oath? What?

Since when this got outside of the sports jurisdiction and got into the legal system? Because if Wells is under oath too I wouldn't believe in a word coming from him. Only in a federal court.
