I haven't been following this at all because i am so sick of it..so the appeal is tomorrow? Will it only last 1 day? many? Do we get to hear eveything said?

No guess it is a closed one!

But you haven't been here for months. ;)
One of the reason I came here is because my friends and especially my girlfriend were getting sick of me ranting and raving about this whole thing. :D

My girlfriend, God bless her, just isn't really following the story and can only humor me so much in regards to listening to the technical details about the flaws in the Wells Report.

What Ian Rapaport said Brady has to do tomorrow on Twitter: "Bring something new to the table and try to prove his innocence to the NFL"

So Brady has to prove science exists and the Ideal Gas Law is in fact, a LAW. Gotcha. What a sham this whole dog and pony show is going to be tomorrow. Just another bite at the apple for the NFL in a typical "down time" for them.

I still can't believe people still think this will be a fair appeal and if Brady does bring something to the table that proves his innocence it will mean anything. Plus, what do they think Brady can produce to prove his innocence? Do people expect him to have a text message where he explicitly states that under no circumstance should anyone tamper with the balls after the refs have inspected them?

One thing not many people have talked about is: Assume Pats deflated balls in the bathroom, but they only deflated each ball by 0.3 PSI, and only spent 90 seconds total. Does that really make any sense? Spent such big effort to just deflate the balls by 0.3PSI each? Really? If I were doing it, I would at least to deflate each ball by 1PSI to make any real difference.

This is the biggest reason I never believed the balls were deflated before the AFCC game. This whole thing is a BS.

not even 'EACH BALL"

just 2 balls if the refs memory is right

I think we are getting to hyped on this appeal hearing. Goodell is not going to fold. He would look like a fool with his new found admiration from the 31 other teams.

He invited Wells to try to provoke Kessler to show his hand through his questioning. I believe this hearing will be a standoff and will go to court. Kessler is too smart to show his hand to a kangaroo court. But he will crucify them when a real court system hears this case.

Some people have suggested Brady accepting some form of punishment because he does not want to go under oath. BS.

Brady has to take this to court to have any recourse to clear his name. Haters will always claim cheating. But a court ruling will clear Brady in genuine public debate

I think it gets reduced to 1..which i am fine with because we will beat the steeleres regardless

Remember Wells bizarre news conference defending his crap report because he was butthurt people would question the great T. Wells?
This from Florio, apparently Wells has thin skin, he likes to dish it out but cant take it, what a coward

And Ted Wells, whose displeasure with public criticism of his work resulted in one spirited conference call with the media and (per a league source) multiple calls to the league office pleading for stronger efforts to respond to those throwing darts at his work, likely will emerge from the process feeling angrier than ever.

The phone is the talking point the NFL is feeding its tools in the media. It's a red herring meant to distract the public from the fact that the Wells report defies science, statistics and just plain common sense.

We all would do ourselves a favor to stop wondering why people in the media keep spooning out their rubbish. It's all about earning favor with their sources or paying old debts to them. Nothing else.

Newspapers are broke. They can't afford to hire real journalists (salary, pension, benefits). Only a select few people really appreciate real journalism anyway.

These days, it makes more economic sense for the newspapers to simply hire a moron who is only skilled at getting people's hackles up. Sad but true.

Agreed...Why did Wells want Brady's emails are texts? Does he have any reason to believe there is incriminating evidence there? If so, why not his computer? What about his bank records -- maybe he paid those guys off? If Brady declines any request, even if it's just for a fishing expedition, that is not being cooperative?

If this was a court proceeding, they'd have to show why they need it.

If this goes to court, some (like John Clayton) says it's risky for Brady because he'd have to give up his phone. I think it's risky for the NFL. They'd have to turn over communications internally as well as communications with Wells. It could be very embarrassing if they have anything they don't want out.

One other point -- Wells is supposedly upset the NFL hasn't been defending him. This describes the NFL to a T. It's all about PR, and if the tide in public opinion turns against Wells, they want to be able to throw him under the bus. Doesn't speak too highly for the integrity of the NFL offices.

I keep hearing this, but I don't hear anyone offering a convincing reason why Brady would have to turn over his phone.

Because discovery (according to a bunch of people who apparently don't know what Brady would be going to court for, and who have little/no understanding of what discovery actually entails).

wrt John Clayton... the guy is a proven moron who knows nothing about football, which is supposed to be his area of "expertise". So no, I'm not going to take any legal opinion of his as sometihng that matters. His opinions that matter begin and end at 1) what it feels like to look exactly like the crypt keeper, and 2) what would motivate someone to grow a skullet.

Yeah.... Considering the "court" case wouldn't be a de novo hearing, just dropping "discovery" really doesn't answer the question. I think we've seen, from day 1, a whole lot of people who don't know what the hell they are talking about when it comes to investigations, courts, trials, the law in general, and a whole host of other things.

It's been illuminating, but I'd have to say that it does not place Americans in a very good light.

No.its no longer about science and dont think it never was. They want him to address the text messages and his phone call for 55 mins after accusations started flying to jaz. Bring something new means , handover the phone.
I think its more about Goody changing the rules of the game in mid stream (more probable than not) and the NFLPA challenging Goody on this. This is the perfect case to do it with, no one slapped their wife or kid and Goody went way over the top with his punishment. This is a gift from heaven that fell into Kesslers lap. Goody being Goody won't vacate Tom's punishment and the NFLPA wants this in court.
Some mediots are already making their talking points saying the NFLPA has the bigger picture in mind and not Tom's best interest. Seeing how Tom's name was front and center in the law suit I'd say they're aligned perfectly.

That 4th grade girl whose science project showed that cooling footballs lowers their psi could probably tear Wells to shreds.

I've been advocating for this PR stunt for awhile... let the 4th grader do the experiment and then challenge Wells to explain why he disregards basic Physics

When Wells repeats that it doesn't matter whether one factors that in or not - the footballs would still be deflated - simply challenge him to document how when and where and with what details he documente

Wells stated that his conclusions would be no different - yet the question of whether or not the friggen balls were deflated IS the central issue here

And while I know people worry, that should this be brought to a court they may request access to Brady's phone and email records, I don't see whether blind allegations of this nature are warranted if the NFL doesn't even have the drive or expertise to accurate measure the ball pressure in the first place

This is why I hope it goes to court: From Currans article:

As for that potential appeal, there will be hurdles to clear in order to get Brady’s suspension “tolled” or suspended if it isn’t vacated. This is where a term called “law of the shop” comes in. Goodell does have the right to mete out discipline in his “shop.” He does not have the right to mete out a disproportionate penalty for an offense that’s unprecedented. Nor is he allowed to hand out discipline based on bad evidence, which the Wells Report is going to be portrayed as.

Well sure, except for all the reports that say pretty much the opposite. Or at least that the needs of the team are too important for him to push it. Frankly, I've seen a lot more of those than I have of the former.

I think the reality is, nobody other than Giselle knows what he's thinking right now.

I haven't heard any reports that "say the opposite" of Brady not going after full exoneration. What I have heard is that Brady hired Kessler and another that he expects full exoneration. That's it. So you have a Wells report with critical flaws, Brady hires best anti NFL lawyer, and a report that says he wants full exoneration. That leads me to think he is going to court.

Don't you worry about finding out the details of what happens. I know for a fact (inside source and all ;)) that the esteemed Chris Mortensen will no doubt post to his twitter the 100 percent factual and accurate account of the proceedings.

So rest easy and sleep tight, because Uncle Chris has you covered.

From the CBA :
(ii) Discovery. In appeals under Section 1(a), the parties shall exchange copies of any exhibits upon which they intend to rely no later than three (3) calendar days prior to the hearing. Failure to timely provide any intended exhibit shall preclude its introduction at the hearing.

So, essentially GoToHell has had everything from tb's lawyers since sat.

It is scheduled for three days. In the real world with the facts AS THEY ARE and ON THE TABLE that would be a 30 second hearing, but this will clearly NOT be about the facts as it never was.

Sadly, all our discussion anticipation is a bit of a waste of time IMO. I expect nothing today or til Friday and then to be told we are going to court, regardless of GoToHell lessening penalty or not.
