Because the report is Brady wants full exoneration. He isn't gonna get that from the appeal.
Well sure, except for all the reports that say pretty much the opposite. Or at least that the needs of the team are too important for him to push it. Frankly, I've seen a lot more of those than I have of the former.

I think the reality is, nobody other than Giselle knows what he's thinking right now.

Saying lack of cooperation is big deal. Basically he says brady will still be punished 2 games maybe for lack of cooperation and brady may have to make a decision of carrying into court vs NFL saying they dont have anything to nail him on except cooperation and he accepts it.
Breer thinks brady will still be punished even if he shows his text messages.

Like, Kraft didn't even need to even threaten to go to court. He could have waited for things to settle, then go have a ****tail with his buddy Goodell and go something like "look, its starting to become obvious that the Wells Report is flawed in many ways. Tom is only going to continue to expose it and thats going to look bad for you. You know I don't want to cause trouble for you too so how about you change the 1st round pick to a 2nd and knock off the 4th. I think that'll work for both of us." Would that have been so difficult?!?

So Brady has to prove science exists and the Ideal Gas Law is in fact, a LAW. Gotcha. What a sham this whole dog and pony show is going to be tomorrow. Just another bite at the apple for the NFL in a typical "down time" for them.
 
I find it funny that Wells is going to "address" the AEI piece. I would be surprised if he could even really grasp it. Looking forward to... "Ehh, your science says this, my science says that, who really knows which is right? Let's just call it a 2 gamer and go home."

This is just a thought I'm throwing out to those on this board who have a legal background: the 2011 CBA was not just an agreement between the NFL owners and the NFLPA, it was also the settlement terms of the Federal court case Brady et al vs. the NFL.

Could Brady go to the judge who oversaw that case and its settlement and ask that judge to hold an evidentiary hearing to determine whether the punishment from DeflateGate is retaliation against him being a plaintiff in that case and seek damages? Such a hearing would have the same effect as a defamation lawsuit.

Could Brady ask the court to throw out the settlement claiming the NFL's changing the threshold for punishment to "more probable than not" represents a material breach of the settlement in Brady et al vs. NFL?

I look forward to what the legal scholars of patsfans.com have to say.

my biggest fear is brady accepts a 1 game or 2game suspension in order to avoid dragging it out mid season . I hope it doesnt happen.
That is my concern too. They'll orchestrate it so he plays opening night but misses Week 2 or Week 3. I don't trust any of them....

No.its no longer about science and dont think it never was. They want him to address the text messages and his phone call for 55 mins after accusations started flying to jaz. Bring something new means , handover the phone.

What reports? All you've seen are mediots who are spewing crap because that's what they want because they know if he does go to court he'll never miss a game. They're all clinging to that hope because Brady not being suspended makes all their vitriol against him look stupid. You know who in the Boston media that has been leading the "good of the team" charge, Douchebag felger, so that's all you really need to know. If a guy like felger is spewing it then you know it's nothing but bullsh*t

I recommend waiting to see what Kessler does. I'm sure every legal issue has been fully briefed by his associates and no stone will be left unturned. He probably wouldn't involve himself in this case if he didn't smell blood in the water.

Suffice it to say, if Goodell is not currently aware of the potential consequences of this matter going to court, he will be after he meets with Kessler at the hearing.

Get your popcorn ready, this should be fun!

Why are we talking about a damn phone ? I feel like going on an Allen Iverson type rant. Are we talking about a cellphone ?!?!!! What does a freakin cellphone have to do with anything ? Tom Brady plays football on planet Earth. On this planet, there are changes that occur in nature - one of which is described by PV=nRT. Are we talking about a cellphone ? WHY is this about a cellphone ? Seriously. Does the integrity of the NFL and football in general really depend on a cellphone ? This is more than BS.


For the record : I would completely side with Brady if he decided a stupid and unjust 4 game suspension is worth protecting the contents of a private cellphone. TMZ would be all over than cellphone - no one with any brains would believe the NFLeak would protect the contents.

The phone is the talking point the NFL is feeding its tools in the media. It's a red herring meant to distract the public from the fact that the Wells report defies science, statistics and just plain common sense.

We all would do ourselves a favor to stop wondering why people in the media keep spooning out their rubbish. It's all about earning favor with their sources or paying old debts to them. Nothing else.

I also think this is all about co-operation or lack thereof (ie not making available requested phone records).
 
One thing not many people have talked about is: Assume Pats deflated balls in the bathroom, but they only deflated each ball by 0.3 PSI, and only spent 90 seconds total. Does that really make any sense? Spent such big effort to just deflate the balls by 0.3PSI each? Really? If I were doing it, I would at least to deflate each ball by 1PSI to make any real difference.

This is the biggest reason I never believed the balls were deflated before the AFCC game. This whole thing is a BS.
