There is another surprise coming Mr Wells way too he does not have a clue about. Can't say more but it will be very fun for all of us when I can say anything.

Such a tease! But I'm ready to give you the benefit of the doubt...but, it better be good and you'd better send us all a link to it once you "can say anything" or you will be "credibility challenged". :)

Even though, when you go to court to challenge the outcome of an arbitration proceeding, the bar is pretty high. This is what interests me. I am assuming nothing is going to change from the appeal this week. So how high is this bar to get a judge to hear this case? I like Brady's chances in an independent court, but what are odds it will get that far?

I'm not any kind of labor lawyer, but a lot of ppl are constantly citing the cba and I think maybe they lose track of the fact that the cba is only very specific and limited language pertaining to the nflpa's agreement with the nfl --- there's still a ton of bigger picture labor law baked in that nobody really mentions.

I think it'll go to court if brady and the nflpa choose to go that route after the appeal.

The Bountygate case cleared the bar at least high enough that Federal court was in play until the 3 man appeals panel ruled in favor of the players, and Peterson's case cleared the bar enough that he won in Federal court.
 
Suspension will be upheld by Goodell and it will go to court. They will lose in court like they did with Peterson and Bountygate - but no one will care. That's my prediction.. Goodell makes enough money so that a few court losses won't bother him.

Its up to Kessler to make this one 'count' so to speak.. Hopefully we see a creative and far reaching lawsuit from him and turn this typical scenario around..

100% chance of it happening. Brady wants the suspension removed, not a reduction.

To the point above - every suspension that has been brought to court had been overturned, and Goodell/ the owners haven't cared about it because there has been no monetary damage to the NFL as a result. Is there any possibility for Kessler to (successfully) argue bad faith abuse of authority as part of a lawsuit for a separate arbitrator? That this suspension/appeal, and the consistent pattern of previous inappropriate NFL behavior - could constitute bad faith abuse of authority and therefore could allow the judge to impose punitive damages on the NFL even before awarding an independent arbitration hearing to Brady? The courts do not want these cases in front of them; they want internal arbitration to handle it. Continually having lawsuits filed due to that process - and continually having only one side be at fault - completely defeats that purpose.
 
Would anyone be surprised if goodell doesn't announce the result of the appeal 1 week before the regular season ? Its almost a month since greg hardy's hearing.

Just a note: The NFL won with the Starcaps case and suspensions.
