Also if part of Brady's punishment is failing to cooperating which is not handing over his phone then where was Gostkowski's punishment for refusing to hand over his phone?
Yep.

Wells will argue that nothing materialized to the point of warranting the need to ask Gost for his phone records.

I also don't buy Wells' point that he would have been satisfied with cell phone print outs. As Yee said, there were no parameters or end game..IE- what exactly he was looking for.
 
Here is the main problem : how many of you have dealt with people who just don't get math ? The science behind the issue is not easily understood by most, because most people really struggle at math. So when you deal with people who just cannot understand, you need to accept that they will be easily fooled by pretty much anyone with a suit that uses words like "algebra" and "formula"...

There is no way of showing people who can't manipulate variables in a mathematical formula "why they got this wrong". And, ultimately, that - coupled with the DESIRE the public has to call the Patriots cheaters - will be the undoing.

The saddest part is that the draft pick is gone. No matter how much science puts the Wells Report in question, that #1 is gone. And there is no reason for it. The Packers lost nothing when Favre refused his phone. Nothing. I want to puke. (Aiming mainly on people who suck at math)
 
I've felt that TB's phone may have some financial info on it that should not be made public for any reason and he will remain steadfast on his refusal to turn it over to the NFL that can't keep a secret.

No chance, that ship has sailed since Kraft would have to take the league to court.

I don't trust anything that I read. I'll believe that Brady is serious when he shows it to me, not when someone else tells me he is.

To heck with the draft picks. Kraft lost the chance to prove his team was innocent of all charges
by evidence that was obviously tainted.

Look if you have seen the witch hunt and the leaks associated with the NFL "investigation/frame job" into this, if you were Brady, why would you ever consider giving up your phone!

Criminals don't have to give up their phones! Most of the time anything used against them comes from Grand Jury subpoenas issued on the phone carrier! Apple's newest OS, even prevents your Imessages (texts between iphones) from appearing even when they have a wiretap on your phone!

Just on principal, no way Brady gives up his phone.

Not only that but these guys(NFL execs) will sell to the highest bidder. Jackals..the lot of them!
 
To me, everything Goodell's done since he messed up the whole Ray Rice thing is to deflect blame to others. First it was the police for not providing the video. Then it was to get Peterson out for the year. Then it was his press conference where he proclaimed to being extremely accessible and not in hiding.

That leads me to believe that if he's going to eliminate the punishment, Vincent and/or Wells are going under the bus. I can't see Vincent but I can see him saying something like Wells has messed up twice, first with NO and now with NE. He might be a good lawyer but he's not a good investigator and the NFL won't be using him any longer.

The worst outcome from the appeal to me would be the punishment reduced to a small fine such as 25k. This leaves Brady at a point where it might no longer be worth fighting.

You are right. They even have the NFL pumping the Patriots balls up to 16 PSI and can't win

At trial if they have a good expert (technically capable but also very good at breaking it down into LAYMAN'S TERMS with analogies and real world examples, like your car tire on a cold day, or the balloon that you buy in January that shrivels when you go outside) you will get the point across to a judge or jury.

I've been a chemistry expert witness at 3 patent infringement trials. The expert's CV sets his/her credentials, then on the stand the expert needs to use no technical jargon and make it just seem like good old common sense.

Now if your concern is that the general public isn't going to ever get it, I can agree. But, done right, the judge or jury can be made to grasp it. They are a captive audience, trying to do their best, and you just have to not blow it by losing their attention by being too technical.
 
This is where Goodell has a problem. If he exonerates Brady and keeps the team penalties intact, he's saying:

Wells was wrong about Brady
Wells was right about the 'ball boys'
Team should have known about ball boys (control)
Therefore 2 draft picks and a million dollars

That sets up the problem of 'admitting' the Wells report is wrong on something, which means....

"Ball boys" get a fun crack at an admittedly flawed report.

The penalty already given also makes it patently clear that any team employee puts a team on the hook, which SHOULD mean that any discipline of any team employee should now require major team penalties.

Goodell is in a completely untenable position...of his own making.

He can't open the floodgates by exonerating Brady and trying to get away with admitting that the Wells report was "a little bit wrong" and a "a little bit right."

He can't let the whole mess go to open court for the obvious reasons.

If he exonerates Brady, he can't set a precedent of using the alleged "misbehavior" of two low level employees as an excuse to levy draconian punishments against an owner.

He be ****ed. I'm not writing those draft picks off just yet.
 
Sal Pal lays out how ridiculous the penalty is in this video. The suggest fine for a team is $20k and Brady is being fined based on lost pay checks of over $1.2 million.

TLDR, but does Brady lose his pay with a suspension? I just figured he got his annual amount whatever happened.

Did he get his full annual contract for 2008, BTW?

Nope, not going to happen. Goodell is in too deep to back off now. He has stacked his tenure on this and he can't lose face, though he likely will by virtue of a court order. He won't do it of his own volition. Someone referred to the "sunken cost fallacy" where you spend so much money, on something you can't change course and that is the Commish. He ordered the Wells report, he owns it and to walk away by reducing the suspension makes him look bad, despite all evidence that no wrongdoing occurred...

The core question is whether the "cost" of having the report, league staff and officials of both the colts and ravens ripped apart in open court is greater than the cost of his "looking bad," taking his lumps and hoping to survive as Commissioner. Sometimes the only viable decision is to to write off your sunk costs.

Injured players (out on IR) get their full pay unless they negotiate an injury settlement & release
