I just wanted to touch on something that I've seen posted a far amount around here. There's this notion that Brady won't take this to court because he'd have to testify and turn over his phone. That is not the case, in all likelihood. We're almost certainly not looking at a de novo hearing here, at least at the start. We're likely looking at more of a due process angle, along with specific CBA issues.
 
Uuhhh, silly question here, but what is more distracting?
- a lawsuit going on in the background.*
- your star goat qb out for first four games of the season.

* regarding my use of word background, no one in this thread ever seems to have heard of the word 'injunction' or 'stay'. My bet is that The first motion Brady's legal team files after filing the suit, if not simultaneous with, is to delay imposition of any possible punishment until the suit is decided. Based on the unrecoverable nature of 4 games, career records, and the scanty evidence I can't think of a sane non-jester-fan judge who wouldn't block go-to-hell's BS. But based on wells report, trial could be over in a day. That crap is indefensible except by the 'I am commissioner-God; F-U theory'.

Post this again so I can "like" it again!

Yes, he IS that arrogant and stupid.
 
The penalizing of Draft picks has nothing to do with the CBA.. That is between the NFL Central office and the teams..

The CBA on the other hand, deals directly with the players.. Goodell can not suspend players arbitrarily and with impunity. This is a misconception. The problem with the current situation is that Goodell is backing his underlings in Kensil and Gardi because they are part of "the League" instead of backing the truth. Goodell, stupidly, doesn't want to admit that his underlings could have done something wrong.
So what recourse does a team have when Goodell decides to pull picks just for the heck of it (for example, what Goodell is doing now to the Patriots). Do they have to sue the league for acting in bad faith? Unfair business practice? What?
 
I hope that once a real judge is appointed Brady happily hands over his phone to him as a huge "fu.ck you" to the league. It would basically be him saying that he doesn't respect the league's bulls.hit "authority" and "accountability" and instead will gladly leave things in the hands of a legitimate servant of the law.
 
Don't forget that Goodell was himself a lawyer too! He knows the letter of the law.

Goodell was never a lawyer. I am not kidding. That is a fact.
 
Again, find me ONE sourced quote from Brady speaking out against the league, the Commissioner, the competition committee, another team, another coach, etc....the ONLY one I can remember is his comment r.e. Harbaugh post AFC Championship game. My feeling is Brady isn't wired to rock the NFL boat, especially since he's acted as a de facto owner/management - type in his contract negotiations...

Even his pre super bowl presser was littered with fence sitting comments....
That's true but that was before the League shat on him....Even the most even tempered guy has his breaking point and getting suspended for 4 games for this trumped up charade is enough to make an innocent person's blood boil and "fight city hall" as the expression goes, all the way to the Supreme Court.. and if you have the financial resources why not go all out to clear your name....?

I don't understand why he really had to in the first place. It's not like they didn't know Brady's personal cell phone. Any text Brady allegedly sent to the trainer is on that trainers phone. It's stupid to be punished for not giving your phone. It says it right in the CBA which Roger seems to twist to only his advantage. You don't have to give your phone to them. So if you don't have to, why are they being punished for it? It really is staggering how stupid these front office people are.

Nope, one of the biggest misconceptions out there. his education stopped at BA from Washington and Jefferson or Washington and Lee or wherever the F he went.......If he were a lawyer, even from a 4th tier school he wouldn't make the mistakes he is making......
Does he impress you as being smart enough to pass the Bar exam???
 
I need help understanding something.

If the CBA gives Goodell authority to punish players then what legal basis does Brady have to take this to court to challenge Goodell's authority?
Deus would know more than me but it has to do with law of the shop

What was the genesis of the "Goodell is a lawyer" belief? Was it because Tagliabue was a lawyer so there was an assumption that his successor would be too? Plus didn't an interviewer ask him about being a lawyer (or framed the question with "as a lawyer...") and Goodell never corrected them?

If it's the latter, how bizarre was that decision? He's the commissioner of the most popular sport in the country. He needs people to believe he's an attorney on top of that?
 
Again I hope I'm wrong here and I'll eat crow if Brady goes for it but it ain't happening... Either doosh Goodell wipes out the suspension or Brady takes what's given....


Hiring Jeffrey Kessler to do your appeal is like hiring Scott Boras to do your laundry. Brady has the best sports labor lawyer there is handling what can only be described as one of the weakest prosecution cases you will ever see, and the sanctions imposed upon him are a joke. Unless Goodell caves this is going to court, and I really can't wait to see what Kessler does to the league office in court.

Goodell is not a lawyer. He did not attend law school. He with a bachelor's degree in economics in 1981 and was working for the NFL by 1982. He's worked there ever since.

I'm not sure where this bit of misinformation about Goodell being a lawyer came from, but it seems weirdly widespread. The first time I ever heard Goodell's name was in Peter King's column back in 2005 or so, when the search for Tagliabue's successor was underway. I think King referred to him as a lawyer then, and it's stuck on some level ever since. Not sure though.
