I haven't seen this discussed, but if the Pats obtain another number one pick, the team loses the higher of the two picks. So the league adds to the penalty by interfering with the ability to conduct normal operations.

Nope. In 2008 Pats had the #7 & #31 pick. The #31 pick was the one that was taken away.

So we have two absolute statements of fact that contradict each other.
I love the internet.
Anyone have clarity?
 
According to NFL*.com:
For the violation of the playing rules and the failure to cooperate in the subsequent investigation, the New England Patriots are fined $1 million and will forfeit the club's first-round selection in the 2016 NFL Draft and the club's fourth-round selection in the 2017 NFL Draft. If the Patriots have more than one selection in either of these rounds, the earlier selection shall be forfeited. The club may not trade or otherwise encumber these selections.
So, if they end up with >1 selection in either round , they will forfeit the earlier pick. They cannot trade away the pick in exchange for a package or otherwise use it as deal leverage to avoid the punishment. At least that's my interpretation of the above language.

It was the SF pick we had. We had two 2's in 2007, we traded the second for SF's first in 2008. Which we used on Mayo. We got Seattle's first in 2007 for Branch.

In 2011 we had two firsts. Our pick and one from Oakland for Seymour. We took Solder with the Seymour pick. Traded our first to NO for their 2nd in 2011 and their first in 2012.

The punishment for Spygate was that the Pats lost their #1 pick, which ended up being #31. However, they had traded a #2 to SF the previous year (which SF used to pick Joe Staley) for SF's #1 the following year. As a result, the Pats ended up with the #7 pick in 2008, even after forfeiting #31. They ended up trading down to 10 for extra picks, then picked Mayo at 10.

In the weeks leading up to the draft, a bunch of idiots in the media whined about how it was unfair that the Patriots still had a top 10 pick even after losing their #1 pick. These idiots, being incapable basic logic, reasoned that the Patriots should have been stripped of the higher pick... because their feelings said so, I guess.

Now Goodell, never one to miss a chance to look ******ed based on some ignorant public backlash, has apparently 'learned' from that episode and clarified the Patriots' punishment this time around accordingly (assuming that you can call the act of getting dumber 'learning').

In short: because Belichick works the rest of the league over so hard on draft day, Goodell had to institute an extra special, extremely punitive measure this time around to make extra sure that Belichick can't trade his way out of the pick deficit.

Patriots trade for the 33rd pick in the draft. Odds are, that will only be a few positions below where they would have picked in the first round anyway.
 
We traded our 2007 first to SF for thsir first in 2008. We also got their 4th.

07 was a crappy draft and BB knew their pick in 08 would be a lot higher than the one he traded. They did end up with a good layer Joe Staley-T

He would not have to do anything. Patriots will not have room in its rookie pool to complete this trade.

"A Club may not assign the exclusive negotiating rights to a Drafted Rookie to another Club if such new Club does not have Room under its Year-One Rookie Allocation equal to at least the original Year-One Minimum Allotment for the player multiplied by the Total Rookie Compensation Pool. The New Club will not receive any additional Room in its Year-One Rookie Allocation or Total Rookie Alloca-tion."

The more I think about this whole shameful farce the more I believe the real target was Belichick and they wanted to kick him out of the league, lifetime ban. Or at least a year.

I think it's pretty simple, the Patriots are basically a lock to make the Divisional round. They can't stand Brady and Belichick getting there easily every year. Even when things don't go easy, like in 2013, BB still did an OUTSTANDING coaching and GM job, building and fixing a roster on the fly. No one would make to the AFCCG without 8 starters or so.

BB owning the Ravens last January, coming back from a 14 point deficit twice, using that scheme with the ineligible receivers was the last straw. BB owning every trade he does making every other GM looking like a fool might have played a part on this too. A bunch of owners might have simply demanded that to Roger "LISTEN YOU USELESS SOB, WE CAN'T STAND THIS GUY ANYMORE, WE NEED HIM OUT OF THE LEAGUE, IT'S HIM OR YOU".

They couldn't plant the seed the way they wanted to incriminate Belichick in the process. It was the desperate attempt, they were sitting in that information about the balls from a long time I believe (it gets Cold in Boston way earlier than January) waiting for the right moment to use that ammo, they didn't have the perfect situation but it was good enough and their only shot because the SB was going to be in the desert and in a dome. They got Brady in the process and even though the SMELLS REPORT cleared BB and the Pats organization they still stole 2 high draft picks to make BB sick to his stomach to the point of retiring or going vocal falling into a trap.

The draft picks makes no sense if the investigation is on the QB as it is now. Yet, even the most honest owner when thinking about this whole issue might have thought "Well the Patriots losing picks and their QB for 4 games doesn't hurt my franchise at all", this could be the rationale for 31 owners, even those who don't play in the AFC or don't play the Pats this year. That's why they put Kraft in the wall and said "Bob, YOU WILL HAVE to accept this penalty".

It's all part of a plan to take the Patriots out of contention for the remaining years of the Brady window. They connected all the dots, the Pats without Brady will have a hard time to make the playoffs, he will get back to the game rusty, if the Bills and Jets live up to their investments it's not hard to imagine the Patriots getting knocked out of the playoffs with 6 losses. In this case they will get a higher draft pick than they are used to, let's get this pick too and avoid any trade. They even covered the Garopollo shining trade bait scenario. The trade off is that if he is the real deal they will have to face the Patriots having a good QB for another 15 years.

Next year Brady will be 39 and without a first round pick. The next 40 and without a 4th that is BB sweet spot in the draft. They basically are trying to end the dynasty years and avoiding a new one on these remaining years.

I agree that the real target of the 31 is Belichick. And the objective is to derail the last years of the BB & TB juggernaut.

This makes Kraft's cave in even worse in that BB and TB are only around for a few more years. Losing play time and draft capital is a kick in the balls.
