If Brady's sole fight is to get a reduction in penalty, while not nothing, this day is even more depressing than before.
Look, there was someone who first challenged the commissioner's punishment decision. There is someone who won a decision. I don't know if any player has overturned guilt, however, if not there always can be a first.
Anything less than Brady getting this in front of a judge/neutral third party to decide guilt will be extremely disappointing.

The NFLPA will go to court to fight for an independent arbiter.
 
If goodell allows a neutral arbitrator and he only reduced 2 games, can brady still go to court ?
My 3L instincts say - without a doubt. People appeal those decisions all the time.
 
And you'd have made the wrong legal decision. The time to go to court is when the appeals under the CBA are exhausted. If Goodell names himself arbiter, the NFLPA will be in court. If the sentence is upheld, the NFLPA will be in court.

There is nothing to fight at the moment. As you say, if the suspension is removed, there is nothing to fight except for a defamation suit. That is absolutely true.

Actually someone with legal experience covered this before. The NFLPA and Brady could go to court now to try to remove Goodell as arbitrator. Because they are arguing that the Troy Vincent punishment and Goodell ruling over it violates the rules of the CBA, they can circumvent the exhaustion of all options.

We needn't argue.

The NFLPA has made it clear that it will not step into an appeal with Goodell as arbiter, without a court fight first.
 
I hope the NFLPA destroys the NFL anti trust provision which the gutless coward and his fellow owners want to protect. It would serve him right for crapping on his fans.
 
If I am Brady and the NFLPA, I am going to court now. I still think Kraft and Goodell have a deal about Brady and if Goodell overturns the suspension, he can do so without exonerating Brady and Brady will have nothing to fight in court other than a defamation suit.
So you think if goodell appoints an independent arbitrator who only reduced the suspension to 2 or 1 games then Brady can't go to court to fight this ? We have to hope Brady is not part of this deal between goodell and kraft .
 
I'd like to believe that this goes full bore resulting in Brady's name being cleared and after that happens the NFL is forced to reconsider the penalties on the Pats because no crime was committed.

I hate to be a negative nancy to a fellow fan. Especially after the day we've all had. But if Brady's suspension ends up in court it's gonna take a loooooooong time. He may get an injunction that allows him to say on the field till the whole thing is settled. But I'd be absolutely astounded if a court case regarding this is over by next draft. By the time it's all done there might not be many outstanding penalties left to reconsider. :(
 
Well if theres a silver lining in any of this brady will not miss a single game this season imo...because he will fight until he is exonerated.

If the nflpa got ray rice, peterson, saints players suspensions thrown out brady should be a slam dunk.

Screw the #1 pick...I want hof brady out there to go after #5 and show the haters
 
Brady wins #5 and retires but still refuses to drop his court case! Sues Kraft and owns the team in 2016. One can dream right.
