Goodell cannot be the arbitrator since he will be a witness in appeal

Question:

If Brady winds up suing can he still play?

I think that Goodell purposely drug the investigation and dog and pony show into May so Brady would have no time to sue before the 15 seasons starts if it gets to that point.

Brady will file for an injunction

will that be granted? or can goodell somehow block it?

I'm not the judge, so I can't tell you the outcome. I would expect that Brady would be granted an injunction, but there's not any guarantee at this point.

If I was the NFLPA, I would get my injunction at the Federal Court in Missouri that declared
that Goodell was not a neutral arbiter because he is paid by the owners.

???

The players negotiated that away in the CBA. Goodell can be the arbiter in a case where someone has been punished by the league.

I haven't read the NFLPA request, but there are at least two elements. One is that Goodell should not be the arbiter because he will be called as a witness. The other is that Goodell is not unbiased. The third, and probably weakest is that Goodell is the one who decided the punishment.

How can "expert" opinions vary so much on if Brady has a chance to win in court etc? I just read another article saying he doesn't have a very good chance to win in court, but i've read several that say he does....it's just so crazy! Someone is talking out of their ass and i just hope it's the ones saying he don't have a very good chance!

Does he have bad breath?!!

Meaning?

Would an injunction allow Brady to still sue Goodell at a later date?

There are two likely injunctions that will filed by Brady or on Brady's behalf. The first could come in the next week asking a court to intervene and not allow Goodell to be the arbiter. Another could happen in August asking the court to force the NFL to allow Brady to play while the courts were decided his case.

Brady can sue the NFL as many times as he wants. So can you.

I believe the goals here are to #1 Get Goodell out of the way and on the defensive. # 2 Try to get this wrapped up by the start of the season. Brady doesn't want this negative distraction around while he has bigger fish to fry.

Because law is ambiguous.

This what you looking for?

I agree, this needs to spread around more.

Yes, sir.

Thank you very much for posting. While it still doesn't clear up the use of the word 'deflate,' it also tells us that it definitely wasn't used in the context that Ted Wells believed it was.

At the end of the day, there is still no evidence whatsoever that suggests that Tom Brady either knew about or ordered the deflation of footballs after the officials had inspected them.

At the end of the day, there is still no evidence whatsoever that suggests the ALLEGED event of deflating EVER OCCURRED at a time SUBSEQUENT TO REF INSPECTIONS during a game or that Tom Brady either knew about or ordered the deflation of footballs after the officials had inspected them.

Fixed that for you.

It really needs to be emphasized in every discussion (particularly with mediots) that
1. The 'deflation is fully explained by temp, pressure, humidity. And
2. inflation and deflation are a regular part of the 2 equip guys' job description and were ONLY wrong or punishable if they occurred in the 3 hours of game time starting IMMEDIATELY AFTER inspection. They obviously had to in/deflate to get them to 12.5 before the game inspection as well. It was never shown to have occurred or even be talked about 'as occurring at that time'.

Which makes this whole saga even stranger. It feels like a bad dream.

As much as we're all hoping to see some things overturned, I have begun to mentally prepare for moving forward without any change. Either way, we can't allow this to prevent optimism or excitement for the upcoming season.

We're the defending champs, have been to the AFCCG FOUR times in a row, and have a reasonable chance of returning yet again. The haters and opposing fans can't take any of that away, and I refuse to let them think that any of it is ruined. Yes, it sucks to see the negativity, but I will be rooting like hell come Sept., even if I have to wear a #10 jersey and a freaking Darth Vader mask. I can embrace the hate much like the 1970s/80s Oakland Raiders if that's what it comes down to.

You're probably right Sup. It's just the way the world works, might as well prepare for the proverbial evil to triumph. Besides we're coming off a SB season and there is plenty to be optimistic about for 2015 (exception being the secondary).
But the link you provided about the 'jkt' is something I haven't seen before. That makes it very likely no one in the media or the league office has seen it (they, literally, aren't putting any effort into exculpatory evidence research or consideration). Sure, maybe the appeal is a predetermined formality, and maybe the legal road is equivalent to a hail mary. But I'll tell you this brother, at this point what I consider at least a partial victory/something to look forward to isn't about fixing the lost picks and suspension railroading.
I ook forward to and consider it a victory when things that have been reported on this board -- and wherever else-- like 'jkt' are put into a single formal well prepared document introduced into an official proceeding. Where the chronology of the texts are now clearly indicated. Where unassailable expert A and B and C say "the Wells Report science is incorrect" and below that 'Walt Anderson stated it was more likely than not he used the gauge that says essentially the PSI readings are explained by physics'. Where it is clearly and factually defined that the football handling and PSI measurements were done too casually to even benchmark guilt. Where the 'not prejudged' NFL in fact did prejudge. Where it is directly stated that Tom Brady, undeniably, never wrote or stated 'deflate footballs illegally(or the like)'. Where it is directly stated that neither of the two equipment guys, undeniably, ever texted or stated they are deflating footballs illegally.

I can't wait for the counterargument to the Well's report finally being official. To me it's a validation for us and what's just. After that I may join you in preparing to look past this fiasco :)
