Patriots Legal Counsel Rebuttal of Wells Report

I don't understand why it's so impossible to understand.

When people work together, they come up with all kinds of inside jokes and terminologies that other people wouldn't get. I've done it with numerous people I've worked with. They're things that build over time with two people who have a sense of humor.

People denying this are ****ing assholes who obviously don't socialize with other human beings.

No one is giving sh** for Deflategate?

I'm not down there now. I didn't take much grief for Spygate, though. It might be different for others, as I'm a pretty big guy. I'll tag @KontradictioN to see if he wants to share what he's dealing with lately.

Awesome, awesome point!
Cant find original post, it was about 17 minutes the Pats had the ball at end of 1st half...the 4:50 or so of real playing time

I've never had to be a Pats fan outside NE...it must be brutal

I live in New York and work for a sports league so I can never escape this sort of BS. I occasionally still have people at the office *****ing about the Paul Pierce wheel chair thing, and it's been what, like seven years? And that is something that unambiguously provided no unfair advantage to the Celtics and was against a team that has nothing to do with New York. I will probably keep hearing about this until I flee the entire tristate area for good. Can I get a few sympathy points my way please?

I've never had to be a Pats fan outside NE...it must be brutal  I bet your Steeler buddies are gloating over Brady being suspended for Week 1 vs. Pittsburgh....Don't worry though, when we win our next Super Bowl, you can shove it all in their faces!!

I agree. On the surface, the 'Deflator'-weight loss explanation is easy to ridicule...you think what you went through is bad....just wait and see....Jimmy Kimmel, Jimmy Fallon, John Stewart, and SNL are all gonna have a field day with this
Not too bad being a pats fan in Charlotte, just smile and tell the haters to gft

I think the Deflator explanation is very plausible. If they had wanted to lie they could have said " it was his nickname because he had a lot of sex with inflatable women".

I'm pretty sure the big needle comment was Jazremski's threat to McNally to watch his bum. "I've got a big needle for ya."

I disagree. No reason to go after Rodgers. In fact, Rodgers should be defending Tom right now.

I think his admission was in defense of Tom then. Would like to see another statement from him.

The Rodgers thing came from Phil Simms during the season. It was way back in October.

So now the haters are latching on to the fact that Mackinnon is a co-founder of a company that Kraft invested in. I don't get why people are resorting to appeals to authority re: easily verifiable, middle-school level science in the first place, but given that that's the direction stupid people appear to be taking this, that is a significant mistake by the Pats. If you're attacking the league for utterly failing to use impartial resources, you should go to pretty great lengths to avoid any appearance of doing the same.

I understand your point but in the long run as long as the science is solid it won't matter if the guy is impartial or not. We have a wells report that was based on Walt's Recollection, two uncalibrated gauges and 11 footballs that would have been evidence but they decided to re-inflate them at half time. All I want is they present a solid enough case that would make Roger think twice about the punishment handed down and whether or not he wants to stand by his Wells investigation in a court of law. I don't think he does.

This document is a road map for a defamation lawsuit. I actually think we'll see four lawsuits filed against the NFL in the coming days:

From Brady
From the New England Patriots
From McNalley
From Jastremski

This document screams "going nuclear". I think all four lawsuits will be filed simultaneously.

The killers are that the NFL told the Pats they had already found them guilty before hiring Wells. The NFL didn't correct the misinformation about halftime PSIs in the media reports, refused to give the Pats the real numbers for two months, and then prohibited the Pats from correcting the record. And the numerous clearly intentional omissions in the Wells report.

The Pats lawsuit will be in the $500 million range, the potential loss in the size of offers when the team is put up for sale.

if pats scientific and legal analysts prove Wells' report incorrect.....he should be violated by a TRUE deflated football....and his CHEESY CAR SALESMAN MOUSTACHE should be shaved off using a plastic butter knife ......WEASLY piece of #%@&$!!!!!!

That would be fun to watch. Could you imagine if there is a Belichick type lawyer out there? Throwing out lawsuit formations that the NFL hasn't seen before. Afterwards Brady could say "I guess the NFL needs to read their litigation rule book".

I lived in Bergen county NJ for a few years back in 2004-2007. When the 2004 ALCS was going on the guys in the shop decorated the entire maintenance room with Yankee paraphernalia. The only thing I posted on the door of the room was the picture of Veritek jacking up Arod on the 1st base line. When the Sox were down 0-3 it was brutal. It was none stop BS all day long. But a day after game 7, I arrived at work to find the only thing left in the office that was baseball related was my poster of Veritek Jacking up Arod. hahaha

My point is that there is a Sports God and you just have to believe. haha

It will be interesting to see if Kraft and Brady file the defamation lawsuits before next week's NFL owner's meetings.

Clearly, the Patriots legal team has already done the preparation for filing the suit. Do they let the NFL stew on that for a few days or go ahead and light the fuse? Brady has absolutely nothing to lose by going ahead with a lawsuit. It's a bigger step for Kraft.

Wells never asked them about it.
He found it later, and that was the reason he requested the extra interview with McNally.
The Pats counsel describer this in great detail.
They inteviewed the Deflator for 7 hours and it ended when they said they had no more questions.
Later they found the text, so they requested him again.
Pats said he had been through enough and cited Wells own words that he would not interview anyone more than once unless new information were discovered. The Pats counsel offered to make him available other than in person, and offered to pose the questions themselves and let Wells know the answer. Wells would not tell them what he wanted to ask, and would not give them any answer to what new information there was.

In other words, Wells told the Pats he would interview everyone once and only once, but if new facts came in, he may need to ask again.
He didn't get any new facts, but found out he missed one. So due to his failure to do his job, wanted to interview The Deflator again, and would not cooperate with the Pats counsel in explaining why he wanted to violate his own ground rules.
This equal Patriots failed to cooperate.

In his conference call yesterday, Wells stated he planned to "confront" McNally about that text. That was his intention for the second meeting, a confrontation, not an interview.

And how deceptive was Wells in his report? The ground rules that he agreed to were one interview, with the only contingency for additional interviews being if new information came up. He does a 7 hour interview, but realizes later on that he missed something in the information he already had. He requests a second interview, but insists it has to be in-person instead of via the phone. When he doesn't get his way, he paints the Patriots as not being cooperative.

It is brutal, I live in Illinois and the crap I get is just insane! Not all are horrible but some truly act like i have no right to be a fan because their "cheaters". But you know what I don't give a crap , I still proudly wear my pats gear and still have pats flag up at work and it will stay there.

I do agree with that. That's the whole reason why all these appeals to authority strike me as being dumb. Literally anyone with a functioning brain and a high school education can plug in the numbers and check out the equation for themselves. At the simplest level--just looking at the relationship between pressure and temperature, without accounting for outside variables--this is something that a reasonably intelligent seventh grader should be able to handle.

Same here. I'm out in L.A. and I had one person try to bring it up at a bar this past weekend. So I asked him if he'd read the report, he said no, I explained a couple points to him, he backed off. Other than that, sure, I've heard some random talk here and there, but nothing crazy. Even when I do encounter jerks, I just ignore em. Not my problem that they're stupid.

You say that but Felger, Mass and Adam Jones still have no understanding of the Ideal Gas Law. Yet they base their conclusions on a text message. I can't imagine what radio stations across the rest of the country are feeding their listeners. In the end if this goes to court it will not matter what Felger and the rest have to say because it will be the science that wins in court.

Yes, because they're on par with an incredibly stupid 7th grader.
