Patriots Legal Counsel Rebuttal of Wells Report

You have to read the Nov 30th text or it looks absurd. That is, in fact, what Bertrand was just talking about, but he ignored that Nov 30th text.



"Give somebody that jacket" makes no sense in a PSI scheme. It makes sense if a guy is dropping weight.


I can see how the wording and the explanation fit but those words are still unfortunate
People are just stupid. If there was ever going to be 2 guys who would use "deflator" as a weight loss term it would be two guys whose JOB IT IS TO INFLATE GAME BALLS. It makes perfect friggin sense given their work relationship.


Here is the thing. They used the word Deflator. Now if the wells report wasn't such a frame job and if the math in the wells report actually added up and if they had recorded pregame pressures because they new they were running a sting operation and if they didn't destroy the only evidence they had when they re-inflated those footballs in question and if they used calibrated gauges so and so on...........then the word deflator might mean something but instead it is the only thing they have to hang their spineless little hats on.
 
With no control group, no knowledge of the original pressure, uncalibrated gauges, no scientific peer group would ever accept the results of the Exponient tests. If they submitted this as a scientific paper, it would be immediately returned to them as garbage. If I had submitted this report to one of my chemical engineering professors, I would have received an F and the recommendation to pick another major. If I had submitted this report to my boss, I would probably had been fired. It's as poor of a scientific report that I have ever seen.

Well, that is what 4 mil gets you these days. Inflation man. Its a real killer.

Granted, but that's only if the court agrees that Brady and/or the Patriots have standing to sue, and even if they are exposed to the lawyers, are they allowed to make those documents public? I hope I'm wrong, but I expect that the communications between Wells and Exponent will never see the light of day.
If this goes to court, I would think that the Wells work data would not be protected under client/lawyer confidentiality since Wells was hired by the NFL as an independent investigator and not as counsel.
 
As Sting would say., If you are gonna do a Sting. Do a good Sting, not a bad Sting.
 
its funny how the media is lambasting the pats over the deflator excuse. I think its important to remember that the men who drafted this counter argument are very smart people and this on the surface is a dumb defense. I could think of many better excuses and I am not a 500 dollar an hour lawyer....such as its his job to deflate and inflate footballs hence the nickname...he was referring to deflating footballs after the jets game cause they were at 16psi...my guess for the lame excuse is because its true and the pats have more text to prove it.

So then they'll just go get 5 other guys that have no affiliation with them that will say the same thing.

If they need 10 Nobel Laureates to vouch for it, that is what they will do.

Don't ask the Poets though. ;)
Or the Peace winners, or the economists.

Chemists, Physicists, Physiology or Medicine though, you're good to go.

There is nothing preventing them from suing. Other than a reversal of all penalties, this is going to court. Documents that are used in court become public knowledge.

If those clowns in the media and hating fans continue talking BS about the Patriots and Brady's legacy after this one, I will just ignore them at this point.

The Patriots rebuttal proves that Wells already had a conclusion, he just needed some so-called evidence to back it. If he had shown all of the text messages exchanged between McNally and Jastremski from May in the time period they were given, it would've added plenty of context to the "deflator" comment. Instead, Wells purposely took two text messages about "deflator" and "...ESPN... yet" out of context and tried to burn the Patriots, well Brady anyway, at the stake for it. The rebuttal also offers an explanation for the "needle" texts. I've pointed out before that prepping balls were not listed in McNally's job description, so I wondered why Jastremski would be contacting him about needles. Well, turns out he gets needles from Jastremski to give to the refs for proper inflation. Those were the things that concerned me and now that I have been informed, I'm more than positive that Goodell is gonna drop this whole case, issue a public apology to the Patriots and Pats Nation and pay Brady a good hefty bonus for defaming his character, "tainting" his SB and exposing him to public scrutiny. I still believe Brady will move forward with the lawsuit. I'm also still laughing at Walt Anderson's testimony about balls going missing and considering going with backup balls, yet security footage shows him walking to the field and finding the balls right where he expected them to be. Witch hunt!

For those that thought Brady was lying about knowing McNally... Brady barely even knew his nickname he called him "Burt" not "Bird" like Bruschi did. If that's not proof enough combined with the fact that he never showered him with gifts, then I don't know what is.

Not sure about an apology but its clear the NFLJETS conspired to paint the Pats in a bad light, they've succeeded but the show's not over. I don't think they expected Bob Kraft to fight this like he has, I know most of the fan base didn't think he would so its not out of the question to think that.
 
People are acting like this is the worst thing since the Beatles breakup. Possibly worst....maybe Pats were even responsible for the Beatles breakup we don't have proof to say they weren't.
 
But that's not what wells said in the report

Wells ignored that statement and coached Anderson to misremember primarily because of the text messages. They had to be addressed because they are the prism that allows Wells to conclude guilt from inconclusive data.

What might have been better is to not have released this at all. As orgasmic as it was to read, dropping it piece by piece into a friendly's lap would likely have given each component more of the spotlight. With it all out, the media will focus on the odd explanation for the texts and after two days they'll ignore the rest since its old news.

I am a scientist and agree. Main thing is the field conditions can NEVER be replicated and times of exposure etc. Fools errand. If we accept the logo gauge numbers, the Pats balls make sense. Hence, no manipulation. Hence all this other stuff is wishful thinking and trying to find something as proof of something that never happened.
