SOURCES: Robert Kraft is 'strongly considering' suing the NFL

Yeah, they know that if Kraft can win a defamation suit, not only will it destroy the Goodell regime, it will hurt the League.

I do have some mixed emotions about that, but it is Goodell and the League who started this. I blame them.
It doesn't need to go to court for Kraft to win and not hurt the league. Use court as a scare tactic and "settle" out of court for the punishment to be revoked.
 
Well honestly I'm torn on this on one hand you would be destroying any relationship with Goodell.
This could in turn negatively impact any future dealings where we may need a favor.

How it impacts the Patriots first lets talk about the damage this has done to the teams reputation.
Spygate was starting to be a bad joke friends tell people were over it and the teams good name was being repaired.
Now we are the but of all jokes,if I hear any more jokes about deflating anything or Brady not being able to throw or us being cheaters and should have the superbowls plural stripped.
Its stupid beyond comprehension for people to think Brady would authorize deflating balls during a game.
Bradys good name and integrity being mocked and laughed at.
His professional reputation is damaged, god forbid his children have read or heard about any of this.
The draft pick is crazy honestly a first round pick is the type of penalty you should receive for tampering and signing hall of fame players from rivals or shooting up steroids in the lockeroom.
Or if the headcoach was running a drug ring or a gambling operation.
In conclusion even though Kraft having to break alliances with the man he sought after and have been thru a lot of positive revenue stream endeavors. This attack on his organization that Kraft has had a hand in building mixed with good fortune, Belichick and Brady wow what luck that was.
He has no choice but to protect his team his people and his reputation. Only way I would not sue is if they drop the suspension of Brady publically apologize to the Patriots exonerating them on all claims. As well as rewarding us our first back and a additional pick early rounds for the sting operation and attack on our name.
 
I would support it but, as another wrote, let's let the Brady issue side out. A win for Brady is a proxy win for the Patriots.
My gut tells me the chances of winning anything from an ownership lawsuit sits between slim and none. So I ask what is the point? Right now I'd like Kraft to use his legal team to provide his own Wells Report and his own reports. Go out and get PSI experts above reproach, more than one. Go out and get an investigator who the media would fawn over (it is what it is: if need be get a gay friendly, liberal friendly one that media would cringe at impugning) . If nothing else make Wells and the Emperor look arbitrary, unjust, even silly. IMHO a win like that in the court of the public, while unlikely to see the picks come back, would not only be the kind of moral victory that has a tangible effect, it would send a strong message to the league that you better think 3 times before ever considering pulling this on the Patriots a third time.

Wells has noted that the Patriots protested loudly that this was a league/Colts (maybe Ravens) hatchet job and he ignored it. What is the chance they have real evidence this happened?

Besides the whole Walt Anderson/gauge thing is simply too coincidental. He knew this was happening but "forgets" which gauge?

How about he knew this was coming down and when the gauge he used showed nothing....He "forgot" but guessed. Sounds like someone wanting an out under oath.

Relationship with Goodell? If he had one in the first place, we would still have a 1st round pick next year.

They went along to get along in 2007. That got them nothing but derision and, allegedly, a harsher penalty in 2015.

He should demand that all penalties be dropped (save perhaps for a token $25,000 fine at worst). And insist on a replacement 1st round pick to make up for the one lost in 2008.

I'd be thrilled by an actual lawsuit, which was litigated rather than settled, for two reasons.

1. The NFL would do everything in its power to discredit the Pats on matters of cheating. I can think of no better way -- indeed no other plausible way -- of the Pats being cleared in the court of public opinion of the charge of generally being a cheating organization.

2. Similarly, I think of no better or even plausible way for the general corruption of the NFL to be brought to light.

3. It would certainly put paid to the idea that Goodell and the NFL office were somehow in Kraft's pocket.

Despite this assumption around the league that the team receives preferential treatment, they aren't getting favors now. At this point, they almost have nothing to lose.

Time for war.
 
It'd be pretty funny (and damning, of course) if they have CCTV of Kensil getting up to no good or audio of what he said to the equipment manager before the half.

And a consistent punishment to the Rats for the Revis tamper. That should be another high pick.

I understand that, but I am just pointing out if it went to court and Kraft won.
 
Perhaps a win for Brady is a proxy win for the Patriots, but it does not address the most damaging of the penalties (IMHO), the loss of draft picks, which would negatively affect the Patriots for years to come.

Yes but the cold harsh reality is the draft picks are for all intensive purposes gone. So if the goal of the fight is to get those picks back then our side is likely to be setting themselves up to be disappointed.

If there was precedent for a team (not player) overturning a ruling and getting the NFL exec committee to rescind punishment I am all ears! If there isn't, as I suspect, then the only chance is based upon a path that has never even been established. Therefore rescinding a team's punishment may be something that does not even exist in procedure or practice. I don't like it but it just it what it is...

Bleacher Report NFL Insider Jason Cole reports that Robert Kraft is seriously contemplating issuing a law suit against the League for the unfair penalties towards the organization. But these same sources are trying to discourage Kraft from doing so, because if he goes the Al Davis route, any outside litigation would be fruitless.

Do you buy these rumors? And do you agree with the argument that suing the League is pointless?

Seems like it goes beyond just defamation but into the area of unfair business practices. The fine hurts Kraft's wallet but suspending TB12 and the draft picks damages the very core of the NEP product - players.

I would love to see the email exchanges between the various NFL front office entities. What was in the emails between Wells and Goodell? What was in the emails between Exponent and Wells?
 
Penalty against Brady should go away with the path he has. My guess is penalties against Patriots stand and other than the first rounder I don't care but what this battle is about is getting rid of Goodell and the Jets rats nest now.
 
Let's hope it doesn't stand want our first there was no reason to have it stripped away.
