I still don't understand this. If Brady didn't have anything to hide (which I believe he didn't) and knew the text records would essentially exonerate him completely why didn't he just cooperate? He had a chance to clear his name and just refused to do so for what reason? I can't think of a logical reason to not to allow the text records to be examined unless there was incriminating stuff in there and knew he was better off just refusing completely.

Can anyone explain why? I'm sure I'm missing something here and would like to hear someone to elaborate on his motive to not allow the text printouts to be processed. That's just the one thing here that doesn't click with me.

You're missing a lot.

First and foremost you're missing the fact that the NFL doesn't investigate ball deflation....until they thought Brady did it.

And that changes literally nothing. But didn't the report indicate that Brady was asked for his phone?

No, p. 21 of the Report says they wanted texts and other documents.
 
I realize that polling shows millennials don't give a damn about privacy, and don't even really understand what it is. Most of the rest of us, however, consider it a very important right.

How many games did Gostkowski get suspended for not turning over his phone?

If they had cell phones back in my 20's and I had to turn it over to authorities, I'd just be getting out of prison now....and I'm 56! :D
 
18 pages of entertainment and curiously, all I am looking forward to now is reading @Deus Irae pick legal holes through Ted Wells' conference call and the inevitable @Joker burn it all to the ground rant. Come on big guy...

Others have already pointed out the incorrect commentary by the assistant, regarding the gauges, and that will be significant if this case gets in front of a judge.
 
BTW, is there anyone here who doesn't delete their texts regularly? If so, now you know better.
 
Brady DID cooperate.. Just because he never gave up control of his phone doesn't mean he didn't cooperate.. This idea that if he had given up control of his phone would have some how exonerated him is false thinking on your part..

Wells is saying he didn't have to give up the phone, just the texts and emails on it that his counsel thought were relevant. If I were Brady's lawyer, I wouldn't have given those texts and emails up without a court order and no way Wells could get that.

Sometimes they are recoverable even if deleted, but your point is well taken.
 
For not cooperating by providing the information asked for, Brady has been suspended for not cooperating. We will all watch. I don't have a clue how Brady will convince a judge that there was significant damage to this good name.

Brady got suspend because Wells said he was aware of what happened. The not cooperating is a ******** reason that Wells knew going in he wasn't going to give up his phone so they could say "Hey look he didn't hand over his phone he's guilty".

Answer me this if Brady got suspended for not cooperating, where is Gostkowski's suspension? He refused to hand over his phone also.

You're right. The real solution is to stop using text messaging. Barring that, though, at least delete them. It's better than nothing.
 
The Wells report plastered text messages to the entire world that made McNally and Jastremski look like complete clowns even though they were probably just joking around. These two guys might be idiots, but they have been completely disgraced and their integrity completely shattered because they trusted Wells to give up their phones. Wells "assured" Brady that if he gave up his phone, everything would be safe - How did that work out for McNally and Jastremski who will be ridiculed for the rest of their lives?

However after this train wreck today, we have a better chance of seeing Jimmy Hoffa before seeing Ted Wells before then end of summer.

According to the writers who were still on hold in the question queue, the handlers abruptly pulled the plug.

So Ted Wells was not being cooperative...
 
The Patriots have handled this as poorly as possible in terms of PR. The reason some teams can openly brag about overinflating footballs, or run trick formations, or take numerous PED's, or heat footballs on camera with no punishment or fanfare is because the mob believes the Patriots are cheaters. And the NFL reacts to the mob. They don't punish because of rule violation, they don't punish because of truth, they punish to quell the mob.

The world believes the Patriots are the biggest cheaters ever because of one made up rule that was violated, and one violation invented from thin air (pun intended). The poor handling of the first effected the second. Really, can you think of any team so famous for cheating? But plenty of teams have had blatant violations. Am I supposed to believe this is because they are so brilliant at PR? Because they know so much about how to handle media scrutiny? I can't imagine how they could have handled things any worse. The NFL convinced the world they deflated footballs without a shred of proof. While having evidence on their side the Patriots convinced nobody. Hell they even announced they would accept the penalty and suspended the accused. Something that makes them look completely guilty.

You can rationalize and say it would have made the court case less effective but it isn't true. They could always go to court. It's just they wouldn't have had to if they hadn't been so unabashedly submissive and obedient during accusations.

Plus Kraft backed Goodell which highlights his poor judgement handling accusations through the years.

You just summarized perfectly why the Pats had a bad PR strategy. The Enblement of Goodell Strategy bit Bob in the butt in the most epic way possible. He thought it was good business. Turned out to be the worst for business.
 
As a former prosecutor who has reviewed numerous forensic searches of cell phones, I can tell you the majority of phones have nude pictures and porn cookies/history.

It's another context issue. When you put "deflator" in among the 16 PSI texts, it looks very bad. However, the "deflator" and "ESPN" comments are from May 2014, and Brady getting pissed enough about the 16 PSI situation to lead to the responses is from October 2014. When you just have "deflator" and "ESPN" in May, that changes the general tenor, at least as far as Brady goes.

Also, take a look at the sender/receiver data of those texts. It's noteworthy that McNally shows up as Bird, not McNally.

Just as a general rule, never put anything that could incriminate you--or could even appear to incriminate you if ripped out of context--in a text format. That includes texts, emails, and IMs.
 
Well's probably didn't expect Goodell to give an unbelievably unreasonably excessive punishment. He likely thought Goodell was smart enough to give them just enough of a slap on the wrist to not lose face with the public. He's probably freaking out at Goodell and NFL, knowing they just royally f*cked up and threw him under the bus. He deserves everything coming his way.

At this point, I really don't care what posters on Reddit or anyone else thinks for that matter. I also understand why Wells would be upset and want to defend himself. Unfortunately, speaking out when you're fired up rarely ends well and I think he did give Yee and his new lawyer additional ammunition.

As for why Tommy hasn't spoken out, he would be wise not to for just that reason. He could accidently give them something they could use against him. I'm sure Tom has put a muzzle on his dad and Gisele as well. However, Tom changing is avatar signals he's ready and willing to fight. At least, that's how I'm taking it.
