Here are snippets from Kessler's war chest:

  • McNeil, et al. v. NFL, et al. - Won jury verdict for NFL players striking down free agency restrictions under the antitrust laws. This victory led to the Reggie White class action, in which the free agency/salary cap system in the NFL was negotiated.
  • Brady v. NFL - Successfully represented a class of NFL players in an antitrust action which led to the end of the 2011 NFL lockout.
  • Players Inc. v. Gridiron and Athletes First - Successfully prosecuted two frontier IP litigations challenging the group use of NFL player images on websites.
  • City of Oakland and Alameda County, et al. v. Oakland Raiders - Obtained summary judgment on behalf of City of Oakland and Alameda County requiring Raiders to honor the team's stadium lease and remain in Oakland.
  • NBA and NFL arbitrations - Represented the players associations in numerous arbitrations involving player free agency rights, circumvention claims, collusion claims, and salary caps.
  • North American Soccer League, et al. v. NFL- Successfully represented North American Soccer League in antitrust case striking down NFL ownership rules.
  • Guidry, et al. v. AFL, et al. - Successfully represented class of AFL players in antitrust case which established free agency in the AFL.
  • Belichick v. NFL, et al. - Represented NFL Head Coach in litigation over changing teams.
  • NFLPA v. NFL - Successfully represented NFLPA in challenge to pro
 
There is no question whatsoever that a real judge would throw Brady's suspension out in a heartbeat.
However, what hiring Kessler signals to me is that Brady has taken off the gloves. They won't be going to court to challenge the suspension, they will be going to court to challenge the authority of Roger Goodell, the entire personal conduct policy, the concept that Goodell can decide that the standard in an employer/employee dispute can be 'more likely than not' and any number of other things that Kessler is smarter than me and adds to it. It will also include a defamation lawsuit for multi-millions of dollars and no doubt would be the end of Goodell. Of course, if Goodell is not a moron it will never get that far, and what we will see is some version of Brady's appeal turning into the NFL revisiting the wells report, finding inconsistencies, inaccuracies and poor quality of investigation and announcing that it cannot stand behind the Wells report, voiding all punishment and apologizing to Brady and the Patriots.
If the league is not that smart, they will lose on the Brady discipline, and many other issues in court.
I don't know about that the way he keeps getting himself in these jams. Of course it could be he thinks he bullet prof after all he has gotten away with over the years. On the other hand like i posted before he has a little megalomania going. He thinks hes Caesar ruling over an empire and his word can't be challenged. And why wouldn't he the owners have giving him complete control and almost unlimited power, they've created a monster.

Brady and Kessler will show that the Emporer has no clothes, if he doesn't overcome his arrogance.
His entire tenure as Commissioner will be on trial.
 
This explains Wells pissing down his leg over the phone. I think Brady is going after the head of the snake.

If Brady has a legal team that is "unreal" like Schefter has meant to have said on SC and Kessler is just the tip of the iceberg, exonerating him would only be a settlement. You don't assemble a team of lawyers that includes the NFL's kryptonite just to get out of a suspension (if it was just Kessler alone then I'd go along with he just wants the 4 games to disappear), you do it because you're out for blood.

Goodell should be pissing his pants right now and trying to get hold of Brady on the phone ASAP other wise, he's done.

Plus, Brady loses $2 million in salary during the suspension, so what does he care about the legal fees?
 
The thing I like most is hearing Kraft is pissed will finally kick some goddamn ass.....

Goodell is farking toast.....Brady/Kessler will tenderize the meat and Kraft will destroy him thereafter.....Vincent, Wells, Kensil, Irsay all better be ****ting their pants now, pain is coming their way

You can be sure the league owners are more nervous than they were yesterday. The anti trust exemption is the soft spot and if Kraft is all in with Brady and Kessler this thing could come the fnck down.
 
I don't know whether this is new (I haven't read the whole thread).

nfl.com is saying that players' association is hiring Kessler and Brady may or may not obtain his own counsel in addition.

In case you missed it flasox I whipped myself with a knotted rope repeatedly while confessing my stupidity and naivete regarding this matter, you and rlCarr were 100% right all along and I was a dope. Bitten in the ass my idealism, what a fool. Can't say it's the first time that's happened either.

As for the hiring of Jeffrey Kessler its exactly what i was hoping for, he is the perfect counsel for Brady and he is going to tear Ted Wells, Goodell, and Kensil a new bunghole by the time this is over. Kessler doesn't wave white flags, rather he believes in more of a scorched earth policy, and in this case that would be the ground those three assh0les stand upon.

Grabbing the popcorn, watching for the fireworks to begin. Can't wait.
