I think there's no appeal process in the CBA for team based penalties, so there's no legal action he can take within the league. But I doubt it grants the league complete immunity from actual legal action, though I admit that's just speculation on my part.

I do think the report and its interpretation were malicious, particularly with respect to the twisted gauge stuff.

I think the issue with BB is that he can get fined for criticizing the league, but I don't see him doing nothing either so I'm interested to see what happens.
BB needs to be in the shadows and provide support. The team can ill-afford to lose him.

We want his energies focused on making sure the team is prepared to win 19 straight games.

That really is the best purpose for BB, IMO.
 
I dont think this league is worth following anymore. Think about it. The priorities are so out of whack and the messages they have sent are discriminatory at best and completely devoid of any morals at worst or, borderline criminal.

Even before this fiasco they should have been on thin ice.

What do we tell the children indeed.
 
I fully expect them to fight but they won't have much of a defamation case against Goodell. It's why the league positioned Troy Vincent as a patsy and Goodell didn't make a statement. Report was published, ten or however many days pass, then penalties levied. They were getting their ducks in a row knowing there would be action taken against them. The league office may be inept and rudderless but they have an awful lot of capital at their disposal and that does afford the opinions and services of competent people.

I expect them to put up some form of legal battle and to negotiate things down to appease the fans but I believe that Kraft has been on the phone with the big families. He's still the most powerful and influential guy in that league and chairs the TV board. That's where you insert the blade and twist if you want Goodell to pay. Step down, watch them blow the deal, and allow it to cost Goodell his job.

And that Freeh report was the basis for a lost sanction. I think that PSU should have been hit hard. But the Freeh report was deliberately malicious, and the wacky thing is, PSU was better off for it because the NCAA had to stand down when the Freeh lies were uncovered.

As great as that would be I think its safe to say that the fix will be in for the rest of the time that BB and TB are with this team. And, I am sure Kraft is not going to endear himself to the NFL with what he is about to do.

We are never going to get a call anymore. Games will be filled of Gronk hugging and Linemen pushing and all that fun stuff.

This is only the beginning. The NWWFL is here and it isnt going away.

Where's BB? We haven't heard from him since the report came out. Hope he's working on getting some dirt up. You have to think he has a long list of cheating other teams have done.
Belichick is focusing on getting the team ready for the season.
 
I am not a lawyer, but from my limited understanding, Kraft wouldn't necessarily be suing for defamation. I would think he would be suing for inequities in the punishment vs other punishments. The League can't just decide to fine one team one way and another team a different way for a simmilar offense. That is why his response was worded the way it was. To show that if they had been given a reasonable punishment they would have gone along with it, but since the League decided to impose a draconian punishment, Kraft felt that crossed the legal line of being equitable, so if given no other recourse, they Patriots will sue.
 
Can Kraft Ban goodell from the stadium? That would be a good first step.
 
That's what the league has positioned themselves for. They clearly established Vincent as the patsy in this legally.

Troy Vincent works for the NFL, any suit would be targeted at the league and not an individual (unless they go specifically after Ted Wells as well as the league).

Out of curiosity then how did Vilma v Goodell happen? Is it a case of person to person as opposed to business to business? Not being argumentative, just want to see if there's something I'm missing as I try to educate myself on this. Thanks!

If he sues on the basis of unequal punishments might the Revis tampering case be "exhibit A" ?

In addition to getting our own lost picks restored might the Pats get a high pick from the Rats based on the precedent that the Omissioner already set?

My understanding:

Vilma sued Roger Goodell for defamation and it got tossed out. If the Patriots were to sue my assumption is it would be for a breach of the antitrust exemption (like the Raiders did) and possibly for malicious use of process.

Tom Brady could target Ted Wells and Troy Vincent ala Vilma and Goodell though. Which is probably the reason Goodell gave the punishment to Vincent.
