If suspended BEGGING Tom Brady to sue NFL

If I were Brady, I'd hire Alan Dershowitz, or Jeffery Kessler and let him go after Anderson, Kensil, McNally, et als, in depositions and, if necessary, in court. They'd get ripped to shreds.


Don' forget Wells, what were his instructions, as well as Goodell, if he was hired to do an independent investigation then attorney client privilege wouldn't apply, if they claim attorney client privilege the the independent investigation is out the window, and thr witch hunt is exposed.
 
I'm wondering if he has a case against ESPN/Chris Mortenson for their erroneous "Mort Report" re the football measurements. I think he does.
 
Part of me wants him to take a huge contract with the CFL and give the middle finger to the NFL. Anything to take power away from the NFL. Most of me likes the Patriots too much to actually want that to happen though.
 
Brady has several decisions to make.

He needs to decide whether he's going to take this further than an appeal to the League with the NFLPA. I say that because I think that the likelihood of an appeal through the League's appeals process, conducted according to the League's rules, is pretty much a certainty.

In order to go make the decision as to whether he should go beyond the League's appeals process, he needs to get legal advice from people who actually know what they're talking about as to what he could do, what it would cost and his likelihood of success. He should probably be talking to someone like Bob Barnett or David Boies. I'm not a lawyer, but the bar for "Defamation" is pretty high when it comes to public figures, so I'm not sure whether that would even be on the table.

If he decides to pursue legal action outside the NFL's appeals process, he needs to decide how far he's willing to go. Money's not the issue as he and Gisele could bankroll a multi-million dollar suit, but he needs to decide if the "Cost-benefit" trade-off is worth it. What would his objective be?

To clear his name? There's really nothing he can do that is going to convince people outside of Patriots Nation of his innocence or lack of complicity in this regard. Minds are made up and they're not going to be unmade. Trying to convince people outside of Patriots Nation that Brady is either innocent or not complicit in "Deflategate" is like trying to convince people that OJ is going to find the "real killer" one day. So, he'd be pursuing that objective for the sake of his legacy, not for any difference it will make in the court of public opinion today. Will that be worth the ten or so million it would cost, with an uncertain outcome in the first place? Only he can make that decision, once he has all the facts.

Scorched earth? Many lawsuits are filed just for that purpose...not to win, but to embarrass the other side in Discovery, etc. Is he angry enough that he would like to tear down the League and those who brought this all to pass? Will that kind of satisfaction be worth the ten or so million it would cost, even if he ends up losing his suit? Only he can make that decision, once he has all the facts.

So, Brady has some big decisions to make that will define not only how many games he plays this season, but his legacy. I don't envy the position in which he finds himself and hope he is getting the very best advice.

That's pretty much how I see it. If he gets suspended will he go through arbitration? I can't imagine him not doing that. But a lawsuit is an entirely different matter. If I were a betting man I'd bet against him filing a lawsuit.
 
I agree that the new poster is probably a troll (joined the Board on Wednesday of Deflategate week? Come on!). And the "Banned for life" stuff is pure nonsense. But, while I would put it differently, the poster does have a point.

Brady alone will be the one to decide whether to pursue this beyond the normal appeals process through the NFLPA.

Should he pursue a "scorched earth" ("Chuck Norris movie") course of action or should he live with the outcome of the appeals process and spend his energy on addressing the impact of all of this on his legacy in other ways over the next several years? Only he can make that decision.

As I said in my longer post above, he has several important decisions to make and he needs to get advice from people who actually know what they are talking about...I freely admit that I am not qualified to advise him in this regard.

I may have just started posting here... and to you that might be ill timed..( I have no idea what I am saying that is trolling) if I don't come off as a complete homer it must be trolling?? Saying I want Tom to go out and win to shut his critics up is trolling??

ANYWAY, I have lurked here for years.. and have enjoyed the forum.. it just happens I severely broke my foot at work and am lied out for a few weeks.. so I decided to join and correspond.. I have NO IDEA what I have said that causes so much grief.. so sorry.. but make no mistake about it, I am a huge pats fan..

Apparently I am not entitled to an opinion without being labeled a troll..
 
It doesn't matter if he wins 10 more SuperBowls, if he doesn't clear his name he will forever be called a cheater.
He will be called a cheater either way.. so go win the sbs and his detractors can shove it..

Not to worry. If you don't follow a certain script in here they accuse you of being a troll. Independent thinkers are frowned upon.

More often than not (99% of the time), first time posters who join the board precisely when things are going bad for the Pats are trolls.

So, I'll disengage from this conversation now and, if over a period of several months I read your posts and it appears that I was wrong, I'll be the first to admit it.

I hope your foot is better.
 
Brady doesn't even need a good lawyer to win. The wells report is so easy to destroy even he could go in at it himself. Brady could hire this lawyer....

Two things:


1) As angry as Tom Brady's father is he is going to be even angrier when the NFL tries to impose discipline on him.

2) Giselle. No one knows or understand the value of name and branding any better than she does, she is going to be the first billionaire supermodel and it's because of her ability to turn her name and image into millions upon millions. There is no way she is going to stand by knowing her husband did nothing wrong and watch his name, reputation, and legacy get dragged through sh.t without as big a fight as they can muster.

Took Brady is his own man, he isn't run by his father or wife, but they are two of the closest people in this world to him and imo they are going to push him hard to fight back with every tool a qavailable. And in this case the NFL is going to try and bring a plastic spoon (the wells report) to a machine gun fight. Brady's counsel is going to she'd that report to tiny pieces and shove it down the NFLs throat.

They won the Super Bowl, so these are not bad times to me.... again, I wish somebody would tell me what I said that makes me a troll.. I was accused on another thread for being a Dolphins fan from some hopeless reactionary which makes no sense because I have completely trashed Don Shula..

As I understand it, Brady/Patriots can not fight any sanctions handed down by the NFL because of the collective bargaining agreement. But does a Brady defamation law suite fall under the CBA jurisdiction? I'm thinking it doesnt. Hopefully I'm right.

My "bad times" reference was clearly referring to the Wells report and the subsequent media firestorm.

I said what I had to say in my post and was very clear both as to why I thought the odds of your being a troll were high as well as to my willingness to be proven wrong. Take it as you want.

At least I'm keeping an open mind and not putting you on "Ignore," which no doubt others have done.

I'm really done with this conversation and will see you around the board.
 
Trust me... I see your point.. he can just deny it.... suing the NFL has a lot of risk... by taking the punishment he doesn't accept guilt.. he can just deny it to the grave.....

Let's say he is suspended four games and the pats go 1-3.. ,Tom comes in and rallies them to another sb victory.... that would HAVE to silence critics...

You talk like winning the SB is a piece of cake. It took 10 years and a miraculous INT to win # 4.

What if Brady doesn't win another SB in the next 3 years?

Bradys rep is almost ruined if accepts this BS. He may have political aspirations post football.

It appears that the "appeal" of any punishment goes to an arbitrator appointed by Goodell (and Goodell can appoint himself). After that, the only option is filing a lawsuit in federal court asking for the decision of the arbitrator to be vacated (which is a non-trivial thing -- courts do not like to vacate the decisions of arbitrators).

I am thinking about it logically. He will fight any punishment they give him and he will win. Anything less than a fight provides the perception of guilt. His fans demand he fight this, he is too competitive to allow them to slander his name.

I wonder if TB could take the NFL to court and force a neutral arbitraitor? I would rather TB retire than take a suspension.

As someone who lives in Toronto, had to put up with Bills coming here (and not even getting the Pats as an opponent), I would laugh my *** off. Toronto Argos even have blue uniforms. Brady looks good in blue too.
