They implied it but never said explicitly they did hence they could not use the word deflate.

Imagine being in court, they would say, we never said the balls were deflated, only that "footballs that were under-inflated were used by the Patriots in the first half". We never said that the Reffs used a gauge to measure PSI pregame only that "game officials inspect the footballs to be used by each team and confirm that this standard is satisfied, which was done before last Sunday’s game" Inspect does not mean measure PSI.
