OT: Hernandez indicted in double Homicide back in 2012

I have to assume they are going to charge Hernandez with attempted murder of the third victim as well as the two homicides.

They found the .38 in a car that was involved in some type of traffic accident out near Springfield, MA. The driver stated some football players left it in the car. I see no way out for Hernandez, other than to attempt an unconventional defense and try and admit guilt but blame it on head injuries or something like that.
 
No offense, but I don't find this situation anything to be celebrating.

Don´t get me wrong, but I have made my peace with this situation. I would prefer H-bomb is still on this team without this crapload.

I am writing in regards to some of the feedback I am receiving from my agents, Florida coaches and other NFL personnel. These sources have indicated that NFL teams have questions about my alleged use of marijuana. I personally answered these questions during the pre-draft process, but understand that NFL teams want to conduct thorough due diligence before making the significant financial investment inherent in a high draft pick. I have no issue with these questions being asked, but thought that it made the most sense to communicate with you directly regarding this issue so you would not have to rely upon second-hand information.

Any information I volunteer to you about my past will be looked at with great skepticism as I am trying to get drafted as high as possible by a NFL team. As such, I thought that the best way to answer your questions and your concerns was to make a very simple proposition. If you draft me as a member of the New England Patriots, I will willfully submit to a bi-weekly drug test throughout my rookie season (8 drug tests during the 2010 regular season). In addition, I will tie any guaranteed portion of my 2010 compensation to these drug tests and reimburse the team a pro-rata amount for any failed drug test. My agents have explained that a direct forfeiture provision in my contract along these lines would violate the CBA rules. However, I have instructed them to be creative in finding a contract structure that would work or in the worst case scenario, I would donate the pro-rata portion of my guaranteed money to the team's choice of charities. My point is simple - if I fail a drug test, I do not deserve that portion of the money.

I realize that this offer is somewhat unorthodox, but it is also the only way I could think of to let you know how serious I am about reaching my potential in the NFL. My coaches have told you that nobody on our Florida team worked harder than me in terms of workouts, practices or games. You have your own evaluation as to the type of impact I can have on your offense. The only X-factor, according to the reports I have heard, is concerns about my use of recreational drugs. To address that concern, I am literally putting my money where my mouth is and taking the financial risk away from the team and putting it directly on my back where it belongs.

In closing, I ask you to trust me when I say you have absolutely nothing to worry about when it comes to me and the use of recreational drugs. I have set very high goals for myself in the NFL, and am focused 100% on achieving those goals. So, test me all you want during my rookie year…all of the results will be negative while I am having an overwhelmingly positive impact on the field.

Sorry, still don't remember a single peep from anyone and by anyone I'm including all the talking head pundits and hyper-critics that are always super quick to disparage any pick at all. Nothing about his potential for violence. Just immaturity issues and most of all, recreational drug use.

Maybe when people said "off the field concerns" they packed "suspected murderer" onto it all.

And maybe when all the articles about his "failing multiple drug tests" came out they included the drug sodium pentathol.

So the cops had all this on AH in July 2012, yet he signs a 40 mil contract, plays a full season and they do nothing until Odin Lloyd is killed in June 2013? Was he ever questioned at all in the double homicide prior to June 2013?

No he was not questioned prior to that.

The evidence trail took time to develop. Who knows the date when they viewed the club video? It's most probable that they initially viewed AH's presence at the club as pure coincidence as would be appropriate given nothing else known. They did not have all that evidence back then; the car and the gun were not found until AFTER Lloyd's execution.
Plus, often cops do not question someone they suspect until they have more information such that their possibly one shot at him before he "lawyer's up" is most productive. It's real, not a TV show where everything comes together quickly. For example, look at the many months the grand jury spent just looking at the assembled evidence.

No one saw any of this coming at all. If he failed a drugs test you could question the team's judgement in drafting him but he didn't. He did the unthinkable...that no one thought him capable of...potentially killing three people. Who knows if it even stops there? Everyone was fooled.

I say potentially because no matter what I or anyone thinks, you are innocent until stated otherwise by a jury and you have that right.

They did not connect Hernandez to the 2012 homicide until after the Lloyd murder. The motive for killing Lloyd is rumored to be his knowledge of Hernandez involvement in the double homicide so the connection was uncovered during the investigation into Lloyd's murder.

I think it is fair to say nobody was looking either. The team clearly did not monitor Hernandez behavior very closely. Since the start of 2012 Hernandez was involved in -

-2012 drive by shooting resulting in 2 murders
-2013 strip club altercation where a firearm was found under a car
-2013 domestic issue in California
-2013 shooting of Bradley in Florida
-2013 murder of Lloyd

I think anyone who was looking would have seen an issue, so I have to believe nobody was looking.

Did you read Jenkins' piece? It's as thoughtful and even-handed as any treatment of this subject could be, in my opinion.

Exactly. And my earlier point was AH was never even questioned in the 2012 homicide and given that I drive an SUV just like it, I was as much a suspect.
The Monday morning QBing in this case is amusing.

Apparently one of the survivors in the 2012 killings, who saw the shooter, isn't a football fan so didn't realize it was Hernandez. Until he saw the news after Odin Lloyd and said to himself, holy crap that's the guy.

So it's been theorized that with an actual eyewitness this case may be an easier conviction than Lloyd, and may actually go to trial first. Pushing the timeline back even more. Of course, eyewitness testimony sometimes can't stand up under cross-examination and only the prosecutors really know what they have, so we'll have to wait and see.

The police weren't looking at Hernandez for the drive by until after the Lloyd execution; that's when the pieces started falling in place for them on that crime, and as they started looking the pieces started coming together and they were able to connect both shootings.

The only part that I am having a hard time understanding is why the survivors of the drive by didn't point to Hernandez from the beginning.

I have to believe that it should be routine in a homicide investigation to investigate who the victims spoke with at the club, and that the police would therefore have reviewed the surveillance tapes. If the tapes show the victims interacting with Hernandez, as is alleged, then the police should have spoken with Hernandez. If they did not, then they would not be the first (but perhaps the most egregious) to give Hernandez a pass because of his football abilities.

Try this. Cops look at video in the days/weeks after the shooting and see AH. They've talked to others at the club and maybe they even decide that AH warrants looking into. In the case of a high profile individual with easy access to a high profile attorney they know that they get one shot at a surprise interview before the lawyer gets between them. Usually the police like to see how much other evidence or information they can gather before shooting off their wad prematurely. That info can be used to set a trap for the interviewee perhaps getting him to lie about some aspect that they can prove false. If so, it's fodder for the DA to portray him as a guilty liar in court.
 
It's my understanding that a person is innocent in Mass until the appeals process is complete.
I may be wrong or, if not, it's changed. The killer of the abortion doctor (committed suicide) was considered innocent because that process wasn't complete, if I remember correctly. If it's possible to cut a guilty plea deal, AHern should do so now. The Prosecution may not offer anything but the NFL should privately use whatever influence it has (it may have none).

This could take years to resolve itself and would have implications of a never ending story about the NFL. A Mass Lawyer should comment on this.
 
The most cap relief I expect from Aaron Hernandez is $4,466,800 and I will not be surprised to see Brady retire before the Pats receive it. $4,466,800 = $3.250,000 final installment of signing bonus plus $1,216,800 (the total grievance amount that I think hit the 2013 cap).
