I thought this was important enough to bring over here...

From Bostongirl210 over at Patriots planet's forum.....

I'm posting this as a warning to all sports fans...and also a call for help. We are a group of Pats Fans, all in our 20's and 30's, most of which have never been to a game at Gillette. Months ago we decided to start planning early for a big trip to one great game.

We bought 28 Patriots Tickets for the 12/9 Steelers game from PremiumTicketsCheap.com on sept 10, which they confirmed and charged our credit card for. 6 weeks later, with still no delivery of the tickets, I called to inquire on a shipping date only to find out that they had refunded the credit card and are re-selling our tickets at a much higher price. (right after the Pats beat the Colts and ticket prices skyrocketed....coincidence? I doubt it)

We began planning this trip months ago, when tickets prices were affordable to us, and upon confimation of our tickets, booked non-refundable transportation.

This ticket broker is going against every policy stated on their website, and we just want the tickets that we purchased!!!!

Please pass this message on to anyone you know so that it doesn't happen to them. If you would like to help us in our fight to get our tickets, we have started an online petition at
http://www.petitiononline.com/patstix/petition.html

Please help fellow Pats fans get to our game!!!!!

That pisses me off just reading it! Why didn't they just send you the ticket immediately? Once you were charged, I would think you'd own them. It's a shame it's probably too costly to get a lawyer. Have you even tried contacting one? If you did, what did he/she say?

have you tried contacting the Attorney General's office? or one of the local tv station's "help me" lines?

You're better off calling the cops or media, it might not do you much good but at least there's the start of a paper trail. Online petitions do nothing.

help me Hank on Channel 7.....AG's office...really a number of TV stations I am SURE would be interested...that they SOLD tickets you already purchased is certainly something for the AGs office... REALLY..something needs to be done about this...

I know she has contacted quite a few different agencies about this situation, i have not heard anyting about it as of yet, but i am following it and will post here when i get more info..... I have instructed them to get ahold of a local Tv station and the federal trade commission and get them involved ASAP, if they have any hope in getting the tickets.....

They got billed for the tickets but were never delivered, when inquired about, the ticket broker said that decided they worth a whole lot more money since the pats were doing so good, than credited their credit card and sold the 28 tickets that were theirs...... Id be furious and would unlease hell upon these people.... please help by filling out the petition, it takes like 5 seconds to do...

Thanks everyone...

Online Petitions = cursing the darkness.

Light a candle. Call the AG, BBB or the cops.

Unfortunately....the company is out of Indiana....so I think that Indiana's AG should be contacted as well as teh credit card agencies involved..clearly, this agency needs to be put out of business...

Hello all.

Thank you all so much for your support in this matter. The more exposure this gets the better.

I have in fact filed reports with the Indiana Attorney General and the Indiana Better Business Bureau. I have also contacted all majoe media outlets in Indiana as many of them have investigative teams for such situations.

Here is an update:
I finally heard back from the company, after all these postings went up online. It seems that it is one guy, operating out of his house. He cites a separate set of policies than what is posted on his main website, as reasons why he refunded my order. These policies can be found in a small scroll box at the bottom of the order form, which does not print when the page is printed.

Basically he is a middle man between the consumer and the broker who actually holds the tickets. Many website are, I've ordered from many others in the past, and never run into an issue with them. When I placed my order, this website, PremiumTicketsCheap.com processed payment on my credit card, after sending a confirmation email and calling me on the phone to confirm my order. They then held payment for 49 days without delivering the tickets. He claims that the fulfilling agency backed out of the deal. If that is the case, then he should have never charged my credit card until the order was in fact confirmed on his end.

His Policies:
"Orders through PremiumTicketsCheap.com will be fulfilled by one of our network of participating brokers. Contact information for the broker who fulfills your order (Fulfilling Broker) will be provided to User during the purchase process. If you lose this information User may contact [email protected] to get information about the order.

PremiumTicketsCheap.com cannot confirm the price of an item until you order; however, the Fulfilling Broker does NOT charge your credit card until after the ticket has been secured."

I know I'm fighting an uphill battle....but I have to fight for it, I really don't want to have to tell my group that this whole trip fell through. At least by spreading the word about this companies shade practicies I can feel that some progress was made towards this not happening again to another consumer.

I wish you the best of luck, keep us updated as things unfold :)

I have it on very good authority, cough, cough, my cousin the professional ticket scalper, cough, cough, that you can't even get into the Pittsburgh game for under $500. (for standing room).

Sad to say, that I feel safer going to a scalper than one of these websites!

As we speak there are 20 tickets available from stubhub.som for 308.00 each and the price increases as do the better seats. ive had nothing but good luck with stubhub, thats where i got my philly vs pats and giants vs pats, thou the giants ticket are 30yrd line and were big bucks, i have the tickets in hand, thou i didnt buy 28 of them....

Yes bostongirl, please keep us informed.

"If the Fulfilling Broker discovers an item's correct price is higher than the stated price, the Fulfilling Broker will, at their discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation."

you have been notified of cancellation, over a month before the event you have your money refunded, we refunded as soon as we found out these tickets where not comming to you. I understand why your group is angry but we have not profited from this transaction in any way.

jim

Now for the record, I wasn't notified. I called him on Nov 5 to ask where my tickets were and Jim claimed he couldn't find any record of my order. That is when I logged into my credit card account and saw the credit for my order on Oct 29.

Jim played dumb and told me he'd have to ask a manager to see what was going on. I called back an hour later and he continued to play dumb, told me "Tom" the manager would be in the office (the business is in his house) later and would contact me then. Since then I receive no response to my multiple phone messages and emails until we started this email campaign.

Sadly I've come to the realization that this will never be resolved before the game and we are not going to get our tickets, regardless of how much we are in the right and deserve them. It makes me sick how disappointed everyone in our group is right now, but I am taking consulation in the fact that word is spreading quickly about Jim and his shady business and that this may keep some consumers from ordering from him in the future.

This sucks for us but I hope it is helpful to others to know what to look out for and what to do when ordering through a broker. Order only through agencies who have tickets on hand, not through these "middle men". Maybe someday the consumer will actually win.

BG210, the point you need to make here is that you are not a money-lending agency. You are not an escrow service. When you pay money, it's not at the convenience of the merchant, who can decide to screw around for a month and a half and then figure out whether he wants to give you what you paid for, or give you your money back. In the time that you front that large sum of cash (which is what, $8,000 or so? more?), you could have done a whole buttload with that money, like invest it, or use it on a host of other things. You didnt' want to do that, you instead chose to buy Patriots tickets, and this jackass denied you your right to do what you wanted with your money. That's the insult here.

I would look up the legal definition of fraud. This may be wire fraud, depending on the definition and the state he is in. The amount of money involved here may make it a major offense, I don't know. I am not a lawyer, but I would tell him that you intend to get one and you intend to put him completely out of business unless he is prepared to furnish you with 28 tickets to the Patriots game, Right Bleeping Now.

Have you documented the policies that were put on his website? Have you saved the confirmation email you got with your transaction? What does that email say?

look, you have an argument here, and you shouldn't get pushed around just because this guy is weak. He's trying to push back because he knows he's in a corner. He will get angry before he capitulates, be ready for that. But ultimately, he's weak, and will fold to wherever the most pressure is coming from. You need to apply more pressure than the ticket supplier is giving him, so go be a bigger threat.

If you click on the "policies" link on his website, you don't find this wording anywhere. Is there another policies link? Are there more policies that you have to agree to when you click to purchase the tix?

ETA: Nevermind. I tried purchasing some SROs for Sunday's game and noticed there is another set of terms that you have to agree to that includes this wording. This is bull.

Regards,
Chris

Jim Kocher can post whatever policies he wishes, but it is against the law to charge your credit card and not deliver said services or product for 6 weeks. Period! I would contact VISA, MC, or whichever credit card company you used to make the purchase and file a complaint.

Further, it does not appear that he is incorporated. Just a single-ownership business with a fairly cheesy-looking web business. I would consider contacting an attorney to file a lawsuit in the state of Indiana.

Personally, I'd call Bob Kraft's office and have them bring down the Thunder. Didn't they just stomp the crap out of stubhub for selling tickets at more than face value?? Pretty sure they wouldn't be too happy about this down at the front office. Wouldn't hurt to at least make them aware of it. It might also be useful to find the article and forward it to your "ticket broker." I'm not sure if this technically applies...but what the hell.

Thank you Thank you to all of you for your help and suggestions.

In response to all your postings:

Yes I have every document that relates to this transaction including website confirmation pages, email confirmations, phone records of calls made, credit card statements, the website policies and tickets listed on all dates, as well as any communication from "Jim the scam artist".

I emailed GoDaddy.com to let them know what is happening on one of their domains.

Yes there are separate policies listed on the payment page, in a little scroll box at the bottom that doesn't print the entire text when the page is printed. Suspicious and sneaky.

I am also filing a complaint with my credit card company.

I did contact the Patriot's office. I received a call back from the ticket office saying they could not help me but they were documenting the information on this site and forwarding to the front office.

I also filed with the FTC, they may not resolve my specific case but they can investigate the company as a whole and shut it down.

I'm fighting with every resource I can find, if nothing else then to shut this guy down. If anyone knows of anything else, please let me know.
