Who says they weren't? We have evidence of cheating last year and this year. Seems like a pattern to most folks. When someone gets caught doing something, it's hardly ever the first time.

I really hope the statement that's eventually released by the Commish includes something like, "The Patriots were not punished because they were believed to have cheated, they merely violated a league rule that they had been warned about."
