I'm not so sure about that. You have a HoF player with medical proof that his brain was damaged by the requirements of the job.

If there is no document that was signed by Seau that removed the team or the league from any liability and if records show that the Chargers, 'Fins and Pats knew of Seau's condition and did nothing, a case will be made for sure.

Seau's condition was never diagnosed by the team and thats what the labor lawyers will be basing their argument on.

Now the court's opinion on if this is even worth a trial is a different matter.

Settling out of court would be a massive Pandora's Box of epic proportions.

Multiple concussions, Post-Concussion Syndrome not addressed by the team and league. Were any neurological tests done?

I'm not saying they will win. I'm saying that they absolutely have a case.

I doubt that the Seau family will win this case considering that they had to do an autopsy to determine the extent of his brain injuries.

That would set a pricey precedent to take, considering all of the other retired players who are also suing for concussion damage in lots of lawsuits.

Settle one and you'll wind up having to pay them all off, and each one gets pricier than the last, once you have caved in once.

It seems like the right thing to do, but I can see the need to avoid doing it.

The league really is between a rock and a hard place on this one.

They want to be compassionate to the retired players and their medical situations, but need to protect their interests both publicly and financially.

Their lawyers will examine the evidence, analyze the plaintiff's argument and the spin doctors and PR gurus will come out with a tactical and strategic view on how to handle this situation.

I don't think that the league will chose to settle out of court either but if they do they'll be a gag order on the cash dispersement so tight that'll you'll only find out if you live to 2099.

First of all, everybody should already realize that any type of brain trauma did not cause Seau's death. He shot himself in the chest. The NFL did not pull that trigger. He did not leave a suicide note, so it cannot be established WHY he offed himself.

The guy played LB for TWENTY years in the NFL , for Christ's sake. Nobody can say with a straight face that he didn't know the risks of the game. It's a violent game. This lawsuit is an obvious money-grab. His family (his ex-wife mainly, I believe) is also suing Riddell for making "unsafe helmets."

Who is to say if the main extent of these injuries didn't occur in high school, college, or the pee-wees for that matter? He also drove his car off a 100-foot cliff a couple of years ago...remember that?

I wouldn't summarily dismiss whether the Seau lawsuit will prevail in a country that rewards people for spilling hot coffee on themselves.

If it is not already being done I am assuming that the NFL and/or teams will require players to sign a waiver indicating they know and accept risk of head injury should they choose to play.

There are currently 3000 lawsuits pending vs the NFL in which the plaintiffs have brain-related trauma and are disabled, etc. that were filed well before the Seau family decided to seek damages for his condition.
