This deserves it's own thread.

It's right there for the taking.

Unauthorized usage of a copyrighted product for one's own material benefit, that also has a marked negative effect on the reputation of the product being used without permission.

The tweet from the Nestle executive yesterday:

@Butterfinger
Nestle Butterfinger
BTW Butterfinger had NOTHING to do w/ Boston stunt after the big game. A company bought our bars (like 7,200) & used 'em w/out our knowledge

I volunteer as a material witness! I'll testify that the incident made me hate Butterfingers and that I vowed never to buy one the rest of my life because of Pawngo's stunt.

The weasels who own groupon are trying to distance themselves from pawngo, only the same two clowns founded both... College frat boy internet geniuses are like a scourge on society...

I think Butterfinger just explained to everyone why they won't be suing Pawngo

How do you know the guys at Nestle aren't loving this free publicity?

You could start a consumer campaign to demand Nestle do just that...using one pawngo/groupon's founders other sites.

Groupon grew out of a website called The Point, a website launched in November 2007 that lets you start a campaign asking people to give money or do something as a group — but only once a "tipping point" of people agree to participate. By delaying action until enough people come together to have a real impact, The Point helps consumers, employees, citizens, activists, parents — or anyone — come together and solve problems that they couldn't solve alone. Learn more about The Point here.

Here's a transcript of my online "chat" with Pawngo:

Ashley:
Hey there, thanks for visiting! I'm here to answer any questions. How can I help?

me: You can help by making a tangible apology to the people of New England.

Just a moment...
me: Hello?
Are you blowing me off?
Figures!

Brittnay:
I am a sales rep ..
if you have any comments regarding that
you can contact [email protected]

me: I absolutely do.

Brittnay: Feel free to contact that address

me: And I assure that neither I nor anyone I know will EVER patronize your slimy organization.

Alternately, they could be fined for littering for each single candy bar, making the fine a few million dollars.

LOL. Ashley & Brittany getting fastracked to crisis management.
Looks like my turn now.

You also can enter a quote request to pawn something. Like, 7,100 Butterfingers candy bars.

Help me with your logic there.

How does:

@Butterfinger
Nestle Butterfinger
BTW Butterfinger had NOTHING to do w/ Boston stunt after the big game. A company bought our bars (like 7,200) & used 'em w/out our knowledge

.....translate into

'Pawngo didn't do anything legally wrong with our copyrighted brandname for their own gain in a controversial publicity ploy'?

Damnit. I LIKE Butterfinger bars. Me & Bart Simpson. Sigh.

These guys really p!ssed me off with that stunt, too. It may take me awhile, and a box of Butterfingers to munch on while contemplating it, but I'll figure out some sort of payback for dissing WWW like that. :rocker:

Word.

Ashley: Hey there, thanks for visiting! I'm here to answer any questions. How can I help?

me: Can you confirm that (720) 320-7777 is the phone number to reach CEO Todd Hills?

Ashley: Unfortunately, we can't give out Todd's cell anymore.

me: When was this policy changed?

Ashley: We intended the policy to be there so customers could directly reach Todd should they have any questions
Buuuuut we got bullied quite a bit so decided to take it down.
If you are sincerely a genuine customer, I am more than happy to give it to you!

me: And did this bullying start to occur, perhaps, in the last 24 hours or so?

Ashley: hahaha yes it did. I'm assuming you're a Pats fan?
Let me just preface that I'm Bears all the way
So you can make fun of Cutler to me if you'd like...
although he really did break his thumb!

me: I've got the right number, right?

And then I was blown off.

Listen, you need to get with the Patriot Way and boycott Butterfingers so they'll sue Pawngo. Switch to a generic brand or something just for a while. :singing:

The alternate to Butterfingers is Margarinetoes but then we would be supporting Rex Ryan. Lose-lose for Pats fans right now.

And then I was blown off.

I called the number and got through to Todd's voicemail. I left him a message to call me back. We'll see.

Until then, here's Ashley's phone number: 303-643-5535

As much as I'd like to see Nestle sue them, they really don't have any grounds to stand on.

It's the same thing as Nestle suing me for taking ownership (by purchasing) of said candy bar and leaving it in a parking lot.

Granted, Butterfingers are nasty and I hate the way that yellow crusty stuff gets stuck in my back teeth.
