Fine points of a Peppers deal...

They will be unconstrained from using their three tags in 2010 if needed;

If 2010 is uncapped, a team will have two tags at their disposal (a franchise and a transistion or two transitions tags.)
 
There is another fine point however. The Pats would MUCH RATHER have the deal consist of a draft(s) picks, for "future considerations" and Carolina withdrawing the tender.

When was the last time a NFL team was able to trade for "future considerations"??

It is an analysis that misstates at least 3 facts.

1.)
as a playoff team would be unable to sign a FA until they had lost as many FAs equal to anyone singed in 2009 or 2010 that qualifies as a FA signing, from another team
Misunderstands the Final Eight plan.
2.)
IOW, they wait until the players, Galloway, Springs, Bodden, Johnson, Baker, Taylor, etc, have been cut or waived, depending on the player's years of service, to be certain that they will incur no penalty in 2010 free agency.
Al Johnson was not cut.
3.)

It is an analysis that does not state how much cash Bob Kraft has to spend in 2010 in order to fulfill his plan.

I think the NFL equivalent is "undisclosed draft choice".

This whole situation reminds me of the Moss trade, because the year before Moss came here, there were crazy rumors going around about him coming here. Then look what happened....BB grabbed him. And concidering the interview that BB had about Peppers about how versital he is, he would/will go after this guy, honestly.

Thanks for clarifying. As I have made no effort to understand the intricacies of an uncapped year, I took some of the OP assertions at face value, as apparently did others.

It reminds me of the ongoing Moss affair a little bit too. Those rumors started a couple of years before he finally arrived on draft day. Maybe it's just wishful thinking but we'll see what happens next year anyway.

Reiss' column has a blurb about this where you can cast your vote as to whether JP comes to NE this season: Schefter '99 percent sure' Peppers won't be a Patriot - Reiss' Pieces - Boston.com So far the No's have it 53.8 to 46.2%.

The article goes on to say Schefter's 99% sure JP won't come here, but gives JT 50-50.

Al Johnson was an UFA.
And we lost as FAs: Snow Angel; Jabar Gaffney and Lamont Jordon. So we lost three and gained one, Al Johnson, we are still negative in count by two FAs. As it stands right now we are entitled to 2 comp picks, probably sixth or seventh round comp picks in 2010.

Incidently, we traded for Greg Lewis and that is also FAs uncapped neutral in its effect, just as it does not effect the eligibility for comp picks. But on the other hand, we can't modify his EXISTING, ASSUMED, contract and buck it up in 2010 by greater than 30%, to cut his 2009 impact. His is a minor contract, so the issue is moot, but the principle remains the same.

For all those nitpickers about the Haynesworth contract, any Peppers contract could be written with the same legalese features that don't explicitly violate the 30% rules but in actuality do so.

Others have speculated how to change a guaranteed bonus, (subject to 30% rules), to a non-guaranteed option (not subject to 30% rules).
For example, the proposed contract includes two non guaranteed options; an option bonus of $X dollars if the option is exercised; accompanied by an option bonus penalty of $X dollars if not exercised. Neither is guaranteed, but taken together the effect is guaranteed.

Heads I win, is not certain.
Tails you lose, is not certain.
But heads I win, and Tails you lose, is effectively a 100% probability. Contractual legalese that subverts the intent, but accomplishes the effect. That is something we would have to do in any possible Peppers signing, I would think.

If Miguel says there are only a Franchise and one Transition tag or alternatively two Transition tags, I defer to the Miguel's expertise,as that's what I read too. But I have seen several blogs that question this,so I included the three possibility. But the exact count doesn't really matter, the desire is to be able to use effectively the tags, without restriction, is important.
