What's the difference between being 17 years, 361 days old and 18 years old?
For this teacher, it makes her guilty of criminal sexual abuse and a registered sex offender.

This is why sentencing guidelines and mandatory minimums are such crap. These scumbag politicians campaign by exploiting the easiest of all possible fear issues: the children. They make you believe that your kids are in constant danger and so every election cycle they try to prove how much tougher on crime they are by making the punishments more and more draconian. Who is going to oppose it? Nobody wants to be the politician who's soft on crime. And so now what we have is a situation where judges can no longer use any discretion or actual judgment whatsoever in ridiculous cases such as this.

Well unfortunately the law has to have a black and white cutoff date for when a minor becomes an adult. The law can't say "An adult can only have sex if their partner is at least 18 years old - well, unless it's a 17 year old who is really mature for their age and really close to 18."

The law has to draw the line somewhere and then, once drawn, enforce it. I have no sympathy for this woman.

If this was ok it would alright for arresting officers to have sex with arrested women or ok for Correctional Officers to have sex with inmates, the reality is that the teacher student relationship is one of power.. and there are very clear rules and boundaries, dumb teacher pure and simple you reap what you sow.

Well, that would be pretty unfair to most women... but no, I don't think the ability to grow a mustache is a fair way to determine adulthood.

Why? Why can't the law say that when an adult has sex with a minor it's either up to the DA or the Judge to use their discretion. It's no surprise you have no sympathy for this woman either. Do you think she deserves to go to jail? If the answer is no, then there is something wrong with our justice system if she does go to jail. Period.
