OMAHA, Nebraska (AP) -- Robert Henderson was not fired as a state trooper because he belonged to the Ku Klux Klan and another white supremacist group, authorities said.

Instead, he was ousted because he could not uphold public trust while participating in such groups, they said.

An arbitrator disagreed, ordering the State Patrol to reinstate Henderson within 60 days and pay him back wages. The state went to court Friday to keep him off the force.

"The integrity of Nebraska's law enforcement is at risk," Attorney General Jon Bruning said at news conference in Lincoln. "The Constitution does not require law enforcement to employ anyone tied to the KKK."

As I see it, the attorney generals logic could also be used to fire fire people who side with Cindy Sheehan. In any case, I presume the ACLU will be on the side of the troopers. I'm not sure which side I'm on. I think the state attorney general needs a better argument, but if there's not one, I suppose I'd be on the side of the troopers.

Yopu have to side with the trooper until it is shown he has participated in a crime or has violated regulations to the point that his firing is warranted. Participation in a group whose objectives are considered to be immoral or unsavory by others is still a protected right. Otherwise, being a Yankee fan could get you fired.

They need to find a way to can this guy. Its a conflict of interest. Part of being law enforcement is using your best judgement. Is this guy going departmentalize his mind? The one thing he has going for him is that he works in Nebraska where there is a very low percentage of blacks. Pity the poor black soul who ventures through his territory. I'd like to hear this guy talk in his own defense.

Ehh, the KKK isn't what is used to be. They still hate everyone, but they don't act on their hate. Much as a it hurts to say (it IS the KKK after all), unless there's a work-related reason to fire him, he should stay on the force.

Hope the ACLU will show up.
Try doing that to a member of the "Black Panthers" or one of Farrakans boys/girls.

Where is this Troopers Freedom, Civil Liberty, and Civil Rights that the "Politically Correct Left Wing Liberal" is always Bleating and Yowling about.

Freedom to the Politically Correct Liberal all depends on what side of the fence you are on, if they disagree with you than your freedom don't mean sh!t.

There's pretty much no way his court testimony against a minority defendant could stand up. That punches a big hole in his effectiveness as a cop; but its still thought crime he's being punished for. Besides, binding arbitration is supposed to be binding.

The municipality needs to suck it up, put him back to work, and assign him duties that will keep him out of situations where his racism will interfere with catching and jailing criminals. My high school had this little, old, fat lady BPD officer assigned there. I say they should give him similar duties and he can spend the rest of his career checking hall passes.
