Even "all the relatives of both Carloses mistook them," and DeLuna was sentenced to death and executed based only on eyewitness accounts despite a range of signs he was not a guilty man, said law professor James Liebman.

Liebman and five of his students at Columbia School of Law spent almost five years poring over details of a case that he says is "emblematic" of legal system failure.

DeLuna, 27, was put to death after "a very incomplete investigation. No question that the investigation is a failure," Liebman said.

The report's authors found "numerous missteps, missed clues and missed opportunities that let authorities prosecute Carlos DeLuna for the crime of murder, despite evidence not only that he did not commit the crime but that another individual, Carlos Hernandez, did," the 780-page investigation found.

This is my issue with the Death Penalty.

By and large, I feel there are certain crimes that, by committing them, said perp has given up their privilege to breathe oxygen like the rest of us.

However, there has to be beyond any shred of doubt that they are in fact a guilty person; caught in the act, DNA or any other form of scientific testing that is beyond my knowledge etc

If one innocent person is executed, then the whole system is suspect in my opinion.

yeah, well, there's your "even one man."

Life w/o parole would be the ideal way to deal with the worst crimes, assuming that even the possibility would be off the table.

I have never believed in the death penalty unless it is a premeditated murder and is proven "WITHOUT A DOUBT" that the accused is guilty.

I firmly believe that Timothy McVeigh, Serial Killers and people like them should be killed immediately following their conviction "the same day" Jeffrey Dahmer should have recieved the death penalty but of course the Killers he was in jail with took care of him.

The system we now have will kill more innocents in the future.

*to be clear, my opposition to the death penalty extends even to this guy. But then, I'm biased... no problem with whacking Bin Laden, and the poor guy didn't even get a trial... haul out your ACLU cards and make a case!

I would rather refer to this situation as 'collateral damamge'


if you want to make an omelet, you have to break a few eggs

it is god's will

the guy probably deserved it anyway. he either had sex with his sister or brother, and killed the neighbors dog......maybe even in a previous life

maybe he was going to do something and the 'error' saved an innocent life that we are not aware of

c'est la vie.......I'm going to make myself a grilled cheese sandwich
