Next ,we know ....we wont serve a meal to muslim customers , and taxi cab wont give a ride to a middle eastern tourist in downtown , or to a "DANGEROUS" black person.
See, I'm not in favor of that. On the other hand, I don't see how the state has the power to tell an artist what they have to do.
It's not like this photographer is the only photographer in the state of New Mexico.

So a small business person should be forced to take on jobs she doesn't want to do?
When I was painting, if a person proved to be difficult I never went back, and if they appeared to be so I never started in the first place. It's part of the freedom of being self-employed, I thought.
I think your decision to take on a client should be your own,, but when you make it loud and clear it was based on gender, race, sexual preference, age then that is violating civil rights. Now we all know people mask this by using some reason such as "person proved to be difficult". We'll never have this prefect but when someone says loudly it was because the person was a lesbian then that's wrong. Let's say a tow truck driver said this and you were 20 miles from civilzation. Now let's say these people are elderly. What's your opinion now?

Imagine all butchers in city "A" decide to not sell Ham and Bacon , for religious reasons.
I understand their concern , but if you live in america , and you are muslim , change the job , don't be butcher , do something else.
If you are photograph , please take peoples pictures or do a different job or stay home.

But the person wasn't a tow truck driver. It's a photographer, she's an artist. What about her first amendment rights?
This woman states that she won't do work that portrays horror movies positively, she won't do anything related to porn or nudes or homosexuality. Doesn't she have the right to choose this as a policy?

I mean if you live in the Bible Belt zone , everything that sounds anti christian , like gay communities ,need to be protected, they wont find too much support in an Unfriendly environement.

Just reading the post. I understand nude and porn, but I think homosexuality comes down to laws. It's either the government gives homosexuals equal right or not.

I'm all for homosexual rights, but this is definitely a very gray area. To your original point, there is an aspect of artistic expression that should be respected. Taking that line of thinking a bit further, a photographer is effectively a participant in the ceremony. That is asking a lot of an individual if they are not comfortable with the situation. Could they even perform the service properly if their heart was not in it?
I don't think it is the same situation as hiring someone of a protected category or renting an apartment. In those cases, you are not participating in their life. In the photographer's case, they are a participant.
I'd have to side with the photographer in this case. They should be able to turn down the work without penalty. There are countless other photographers available to perform the service.

I am not for homosexual rights but to me its a simple case of settled law. The photographer can not discriminate against them based on their sexual preference. Maybe its the lawyer in me over riding my political beliefs but that’s just the way the law is.
