I guess you aren't aware that police generally do not charge people with hate crimes (just like if someone kills someone else, the police on the scene aren't going to decide whether it's 1st degree murder, 2nd degree murder, manslaughter, etc.). That is something which happens at the level of the prosecutor. Using your example of you coming into my business, I agree that you would certainly not be charged with a hate crime.

But if you did such a thing in a gay bar (using, as I mentioned, something other than glitter) then you better get ready for some overzealous DA to add "hate crime" to the list of charges levied against you.

No (and quite honestly I have no idea what perverse twist of logic you employed to come up with that conclusion following what it was I actually wrote).
