If Comrade Obama's wife had her way that would be exactly the case.

One ruling out of a total 17 rulings, have denied the constitutionality of a portion of the bill. 14 were dismissed. 2 were ruled in favor of the bill's constitutionality. Only one sliver of the bill was ruled unconstitutional.

One might think that the whole bill was thrown out, just a portion.. by a judge, who at first glance appears to have a conflict of interest, and should have recused himself from the case..

More about this "activist judge"..

Quote:
Hudson has admitted missteps. In 2008, Hudson published his memoirs, Quest for Justice, and acknowledged that “during my early years as a prosecutor, I was narrow-minded and at times offensively self-righteous.”

He also admitted to a failure, at a critical moment in his career, to tell the full truth. “I lied to the General Assembly and the Fairfax County Bar Association when I told them unequivocally that I had no intention of seeking a federal judgeship,” wrote Hudson, who served as a judge in Fairfax County, Virginia, before joining the federal bunch. “Perhaps lied is too strong a term.”

How is paying money to an insurance company a tax?

The mandated purchasing of health care is absurd. Talk about corporatist.

This genius move was followed by trading out of a spot where they could have gotten the last decent receiver in Robert Ferguson and settled for tackle Matt Light, who will not help any time soon.”

I agree. Universal single payer would be very much preferable.

There are numerous ways you can look at it. You could view it as a tax, in which case it's constitutional. Or you could view it as a regulation, like the minimum wage, which forces private actors to behave a certain way.

At the end of the day, I think the strongest case, as Mark Hall argues, is that the mandate falls under the government's plenary power to tax income. But really, since the insurance companies will file in support of the mandate, I'd be surprise if the corporatist Roberts court would rule to overturn.

your scenario seems plausible ... but with the masses currently angry with Congress I'm not sure they have the cahones to go against the people. It will be interesting to watch as the left will favor legislation from the bench and the right will push to have it drop in Congress's lap again. In any case ... that they wrote this mostly behind closed doors will work against it.
