In-state tuition for illegal immigrants is preserved with California Supreme Court ruling

The California Supreme Court decided unanimously Monday that illegal immigrants may continue to be eligible for in-state tuition rates at the state's colleges and universities rather than pay the higher rates charged to those who live out of state.

In a ruling written by Justice Ming W. Chin, one of the panel's more conservative members, the state high court said a California law that guarantees the lower tuition for students who attend California high schools for at least three years and graduate does not conflict with a federal prohibition on giving illegal immigrants educational benefits based on residency.
I always thought federal law trumped state law?
Why does this never seem to be the case in California?
Feds: If you are in the country illegally, NO BENIFITS!
Hippies: If you go to school for a while, BENIFITS!
Certainly seems to conflict to me if they are illegal.

If one is here ILLEGALLY, then you shouldn't be able to go to ANY college even if you pay 100% of the tuition.

If you're trespassing, you aren't entitled to anything a true US citizen is. That SHOULD be the case anyway...

No bailout money for CA.

Discriminate against US citizens in favor of criminals......

Our federal gov't BETTER NOT bail out California!!

That would be a SERIOUS mistake.

I'm really disappointed with you people. They are not illegal aliens - that is so, you -know -what.

They are undocumented people.
As in:

" the dog ate my documents"
"the courthouse where my documents are burned down"
" I left my documents in my other pants."

Just becasue they are here breaking the immigration laws of the country is no reason to call them illegals. Feelings can be hurt by those kinds of words.

They already do that here in MA and as someone pointed out on Howie Carr's show if you are an American from NH you have to pay the full boat but, if you're here illegally you get a free ride.
