Bujshmay have authority, but the congress needs to vote it, and in this instance they voted it on the basis of improper intelligence furnigshed by Bush, and then by Bush OUTRIGHT lying to the congress about the WMD's, etc, when he lknew that they did not exist based on the Joe Wilson information, and other CIA information when they told him tghat the Niger report was false but he used it anyway...
And, to do that, IMO, is treasonous...You can not LIE to the congress to get them to vote for invoking the presidential war powers. If it is not treason, it is, at the least, a constitutional felony.
NEM... I totally get that viewpoint...but a good read of the resolution shows that WMD's were just once part of this resolution...and not the most important at that.
Saddam's history of invasions and genocides alone would get Bush off the hook. As to the lying to Congress about WMD's...a prosecutor would have to prove there were absolutely "zero" WMD's in iraq at that time...that would be impossible to prove at any level for either site...too much ambiguity.
I would imagine a jury would be split along party lines for the most part...which leads to not guilty.
